A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD PROTESTING THE EXECUTION
OF CONTRACTS FOR LANDS WITHIN ONE MILE
OF THE CITY LOCATED IN AGRICULTURAL
PRESERVES.
WHEREAS, the City of Bakersfield has received notice
pursuant to Government Code Section 51243.5 that the Board of
Supervisors of Kern County is to consider execution of contracts
on Tuesday, February 15, 1977, pursuant to the California Land
Conservation Act of 1965, also known as the Williamson Act (Sections
51200 et seq. Government Code), which include lands within one mile
of the City of Bakersfield; and
WHEREAS, in the event the Board of Supervisors of Kern
County executes the contracts, the City of Bakersfield desires to
retain a right, upon future annexation of the lands, to exercise an
option to succeed to the rights, duties and powers of the county
under the herein-described contracts as to land now within one mile
of such city pursuant to Section 51243 of the Government Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. That the City of Bakersfield, pursuant to the pro-
visions of the California Land Conservation Act of 1965, also known
as the Williamson Act (Sections 51200 et seq. Government Code) hereby
protests the execution of any contracts for lands within one mile of
the City 0f Bakersfield as set forth in the Notice dated December 29,
1976, more precisely described as follows:

2. That the Local Agency Formation Commission of Kern
County is hereby urged to uphold this protest and make its finding
that the contracts are inconsistent with the publicly desirable
future use and control of the land above described.
3. That the City Clerk is instructed to forthwith file
certified copies of this Resolution with the Local Agency Formation
Commission of Kern County and with the Clerk of the Board of Super-
visors of Kern County and transmit a copy thereof to Tenneco West,
Inc. P. O. Box 9380, Bakersfield, California, 93309.

I HEREBY CERTIFY that the foregoing resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 24th day of January, 1977, by the follow-
ing vote:
