HomeMy WebLinkAboutRES NO 91-76RESOLUTION NO. 91-76 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD APPROVING THE KERN COUNTY FEDERAL AID URBAN PROGRAM FOR THE .BAKERSFIELD URBANIZED AREA, CITY OF BAKERSFIELD, AND CONTINUING IN EFFECT THE APPROVED COOPERATIVE PROCESS-, RESPECTING THE 1976 FEDERAL HIGHWAY ACT. WHEREAS, the 1973 Federal Highway Act established, and the 1976 Federal Highway Act continues, the Federal Aid Urban (FAU) system program; and WHEREAS, the State of California, Department of Transpor- tation has set down certain policy procedures for these programs; and WHEREAS, in accordance therewith, the cities of Arvin, Bakersfield, Delano, Ridgecrest, Shafter and Wasco, the Lamont urban area, the State of California, the Golden Empire Transit District and the County of Kern have formed and functioned as the Kern County Federal Aid Urban Cofr~f, ittee, with the County of Kern in the role as "Lead Agency"; and WHEREAS, the said FAU Committee formulated the process and program, respecting the 1973 Federal Highway Act set forth as Exhibit '~" in City Resolution No. 95-74 and duly transmitted in accordance therewith; and WHEREAS, the Kern County FAU Coff~f~ittee Cooperative Process approved by said Resolution No. 95-74 is continued in force respecting the 1976 Federal Highway Act, a copy of which is attached hereto as Exhibit '~"; and WHEREAS, the Kern County FAU Program for the Bakersfield urbanized area, City of Bakersfield,'respecting the 1976 Federal Highway Act has been duly formulated and is ~.ttached hereto as Exhibit "B"; and WHEREAS, the City of Bakersfield has prepared a diagram delineating and establishing the 1974 Federal Aid Urban Boundaries and System Routes for the~Bakersfield Urbanized Area, which diagram is on file in the Public Works Department and City Clerk's office and by such reference incorporated herein. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That the Kern County Federal Aid Urban Committee Cooperative Process, heretofore approved by City Resolution No. 95-74, i.scontinued in force and approved, respecting the 1976 Federal Highway Act, which is set forth in Exhibit '~," attached hereto and incorporated herein. 2. That the Kern County Federal Aid Urban Program for Bakersfield Urbanized Area, City of Bakersfield, respecting the 1976 Federal Highway Act, all as set forth in Exhibit "B" dated November 8, 1976, attached hereto and incorporated herein, is hereby approved. 3. That the said Cooperative Process and Program approved herein respecting the 1976 Federal Highway Act is recommended for approval by the Kern County Council of Governments and the California Highway Commission. 4. That the 1974 Federal Aid Urban Boundaries and System Routes for the Bakersfield Area, Kern County, California, as shown on the diagram referred to in the recitals above, on file in the Public Works Department and City Clerk's office and by such refer- ence incorporated herein, is approved. 5. That the City Clerk is directed to transmit certified copies of this Resolution to the Kern County Road Commission, the Kern County Council of Governments, to Cal-Trans, District 06, P. O. On April 9, 1974, the Board of Supervisors of the County of Kern established a Federal Aid Urban Comm~!ttee and accepted the role as "Lead Agency." The Federal Aid Urban Committee has established the following procedures formulating its recommendations to the Board of Supervisors. Each agency is to have only one vote. Only the jurisdiction involved will vote on an issue. Minority reports and appeals may be made to those agencies who review or approve the Committee 's recommendation. The =process" which is recommended follows: 1. FAU System - Portions of the Arterial and Collector system of the Functional Classification System, within present urban limits, were adopted as the FAU System. Project Selection Basis - The following items were approved as a 'basis for establishing priorities: State of readiness Travel volume Benefit to travelling public Benefits vs. costs Deficiency of existing system The Program and/or Process will be subject to review and update as warranted due to changes in cost estimates or other requirements. All funds, including those generated by the Naval Weapons Center and Edwards Air Force Base are to be distributed to eligible urban area on the basis of current population, and that the population of Ridge- Crest be the sum of the population within the urban area outside of 'the Naval Weapons Center plus one-half the population within the urban area and within the Naval Weapons Center. - This process has' involved all cities within urban or urbanized areas, as defined by the Federal Government, the County of Kern, the Golden Empire Transit District (Bakersfield Area) and the two districts of the State Department of Transportation. Although unanimous action has not been achieved on each action, all agencies have participated cooperatively in making these recommendations. '~ In the Bakersfield Urbanized Area, this Process and Program must be approved by the City of Bakersfield and Kern County Council of Governments. After approval of the "Process and Program" by the Board of Supervisors Of the County of Kern, it will be forwarded for approval to the State Transpor- tation Director, for review to the State Transportation Board, and approval by the California Highway Commission.
