HomeMy WebLinkAboutRES NO 85-76RESOLUTION NO. 85-76 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE ALLEY EAST OF OLIVE STREET AND SOUTH OF BRUNDAGE LANE, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 4th day of October, 1976, the Council of the City of Bakersfield, pursuant to the provisions of the ~ "being Division 9, Part 3, of the "Street V~cation Act of 194!~, Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 915, declaring its inten- tion to order the vacation of the alley east of Olive Street and south of Brundage Lane, situate in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hear- ing all persons interested in or objecting to said proposed vaca- tion, which said hearing was held on the~ day of November, 1976, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That the alley lying'~s~'_~£'Olive Street and south of Brundage Lane, situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: A parcel of land situate in the City of Bakersfield, County of Kern State of California, being a portion ofthe NW~ of S~ction 1, T 30 S, R 27 E, M.D.B~.& M., and more particularly described as follows: All of the alley of 20 feet in width, lying within the south 20 feet of Lot 77 and the east 20 feet of Lots 75 and 76, Tract No. 1549 as said lots and tract are shown on a map recorded in Book 7 of Maps, pages 95 and 96, records of said Kern County; EXCEPTING AND RESERVING the north 5 feet of the south 20 feet of said Lot 77 for Public Utility Easement purposes. 2. That said alley lying ~a_s_~_~of' Olive Street and south of Brundage Lane, be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 915. Reference to said Resolu- tion of Intention is hereby made for further particulars. 3. That the owner of Lots 74, 75 and 76, said Tract No. 1549, shall dedicate to the City and improve an additional 10 feet of alley and an alley turn-around as described on attached Exhibit '~" and as shown on attached Exhibit "B." 4. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the TS~h day of November, 1976, by the follow- ing vote: CI~LE~ and Officio Clerk of the Council of the ity Of Bakersfield APP_ROVED this 1st ~of November, 1976 ..... ~~i~~yof Bakersfield - APPROVED as to form: CITY ATTORNEY of f Bakersfield EXHIBIT "A" That portion of Lots 74 and 75 of Tract 1549, in the northwest quarter (NW~) of Section 1, Township 30 South, Range 27 East, M.D.B.& M., as per map recorded May 17, 1950, in Book 7 of Maps at pages 95 and 96 of Official Records of Kern County, described as follows: BEGINNING at the northwest corner of said Lot 74; THENCE (1) along the west line of said Lot 75, N 0o40'47'' E, 2<'L12 feet to the beginning of a nontangent curve concave northeasterly, with a radius of 520 feet, the radial center of which bears N 24o36'45'' E; THENCE (2) southeasterly along last said curve, through an angle of 4°45'15'', an arc distance of 43.15 feet to a point of compound curva- ture with a curve concave northwesterly, with a radius of 30 feet; THENCE (3) northeasterly along last said curve, through an angle of 61o09'02'', an arc distance of 32.02 feet to a point of reverse curvature with a curve concave southeasterly, with a radius of 30 feet; THENCE (4) northeasterly along last said curve, through an angle of 55o22'05'', an arc distance of 28.99 feet to a point of tangency in the north line of said Lot 74; THENCE (5) along the north line of said Lot 74, S 89°19'10'' E, 10.00 feet to a point in a line 20 feet westerly of and parallel to the east line of said Lot 74; THENCE (6) along last said parallel line S 0o40'24'' W, 15.51 feet to the beginning of a tangent curve concave northwesterly, with a radius of 20 feet; THENCE (7) southwesterly, along last said curve, also being in the southerly boundary of that parcel of land described in Boo~ 4661, page 930 of Official Records of Kern County, through an an~le of 104°52'21'', an arc distance of 36.61 feet to a point of compound curvature with a curve concave northeasterly, with a radius of 530 feet; THENCE (8) northwesterly, along last said curve, and continuing along said southerly boundary, through an angle of 8°35'16'', an arc dis- tance of 79.44 feet to a point in the west line of said Lot 74; THENCE (9) along the west line of said Lot 74, N 0o40'47'' E, 8.80 feet to the point of beginning~ ' / Sec I TSOS R27E · :~, ~./ ' ~' / . ~.
