HomeMy WebLinkAboutRES NO 82-76RESOLUTION NO. 82-76 RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF BAKERSFIELD. WHEREAS, the Public Employees' Retirement Law permits the participation of public agencies and their employees in the Public Employees' Retirement System by the execution of a contract, and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said law; and WHEREAS, one of the steps in the procedure to amend this contract is the adoption by the legislative body of the public agency of a resolution giving notice of its intention to approve an amend- ment to said contract, which resolution shall contain a summary of the change proposed in said contract; and WHEREAS, the following is a statement of the proposed change: Provides 15% increase in allowances to or on account of certain miscellaneous members retired or members deceased prior to July 1, 1971. Agancy hereby agree as follows: A. The following subparagraph sh~11 be added to Paragraph 8 of said contract: Section 21222.6 (providing for 15% increasesin allowances payable 8.(e) for time commenc.'.mng'on the first d.a~ of the 6a~endar mo~th coincid- 'i~g with or next following the effective date of t~s amendment or on accomnt of certain miscellaneous members retired or deceased prior'~o July l, 1971). Bo Paragraph.8.5 shallbe added to said contract: Public Agency, in accordance with Section 207~0, Government Code, shall cease to be an ',employer" for purposes of Chapter 6 of the Public Employees, Retirement Law effective as of the effective date of this amendment to this contract. Accumulated contributions of the Public Agency asof the date of such amendment shall be fixed and dete~-mLned as provided in Section 20759, Government Code, and such accumulated contributions and contributions hereafter made sh~l:l be held bythe Board as provided in Section20759, Government Code. Paragraph 9 (a) shall be stricken from said contract and the following paragraphs sb~ 1 .be subs~;Ltuted therefor: 9- Public Agency sb~11 contribute to said Retirement S~stem as follows:- a. (1) With respect. to miscellaneous members, the Public Agency shall 'contribute the following parcentsges of monthly salaries earned as miscel3~eous members of said System: 0.565 percent until June 30, 1980 on account of the lia- b~14t; for prior service benefits. (2) 9.328 percent on account of the liability for current service benefits. .. (3) 0.168 uercent on account of the liability for the 1959 Stu-vlvors program. .0.~00 percent for five (5) years from September 16, 1973 to provide the benefits under Section 21222.1 of the Govern- ment Code.
