A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ACKNOWLEDGING RECEIPT OF A COPY
OF NOTICE OF INTENTION TO CIRCULATE PETITION
AND AN AFFIDAVIT OF PUBLICATION AND CONSENT-
ING TO THE COMMENCEMENT OF ANNEXATION PROCEED-
INGS AND CIRCULATION OF PETITION FOR THE ANNEXA-
TION TO THE CITY OF BAKERSFIELD OF CERTAIN
INHABITED AND INCORPORATED TERRITORY IN THE
COUNTY OF KERN, DESIGNATED AS '~WHITE LANE
NO. 10."
WHEREAS, requests that the City Council consent to annexa-
tion proceedings have been filed and the City Council has received
a favorable recommendation from the Planning Commission of the City;
and
WHEREAS, the Local Agency Formation Commission of Kern
County has designated White Lane No. 10 as Annexation No. 228 and
Proceeding No. 509 and has by Resolution No. 76-28 adopted on
August 24, 1976, approved the proposal for annexation and the
boundaries of the territory proposed for annexation, which boundaries
are particularly described in Exhibit "A" of such reference, and by
this reference made a part hereof as if fully set forth herein; and
WHEREAS, on October 1, 1976, there was filed with the
City Council of the City of Bakersfield a copy of Notice of Inten-
tion to Circulate Petition For Annexation, together with an affi-
davit of publication of said notice showing publication thereof on
September 30, 1976, in the Bakersfield Californian, a newspaper of
general circulation published in the City of Bakersfield; and
WHEREAS, the Annexation Act of 1913 provides that the
legislative body may adopt a resolution acknowledging receipt of the
notice and approving the circulation of the petition.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. That the receipt of the Notice of Intent to Circulate
Petition and Affidavit of Publication thereof be and the same is
hereby acknowledged.
2. That this Council grants its consent and approval
for the commencement of annexation proceedings and the circulation
of petitions in connection with the inhabited territory fully des-
cribed in Exhibit J~" referred to above, designated as 'White Lane
No. 10," under the Annexation Act of 1913 (Government Code Sections
35100 et seq.).
3. That the petition may be circulated twenty-one (21)
days after the publication of the Notice or not earlier than
October 21, 1976.
4. The petition for annexation shall contain a request
that the question submitted to the electors residing in the terri-
tory proposed to be annexed shall be whether the territory shall
be annexed and the property in the territory subjected to taxation
after annexation equally with the property within the City to pay
the bonded indebtedness of the City of Bakersfield outstanding for
the acquisition, construction or completion of municipal improvements.

I HEREBY CERTIFY that the foregoing resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the llth day of October, 1976, by
the following vote:
