HomeMy WebLinkAboutRES NO 35-76RESOLUTION NO. 35-76 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ESTABLISHING THE CITY COUNCIL AS THE PARKING AUTHORITY FOR THE CITY OF BAKERSFIELD, IDENTIFYING PROPERTY USED OR TO BE USED FOR PARKING PURPOSES AND TRANS- FERRING ADMINISTRATIVE CONTROL OF SUCH INVENTORY TO THE PARKING AUTHORITY AND DIRECTING THE DEPOSIT OF ALL PARKING REVE- NUE TO A PARKING AUTHORITY FUND HEREBY ESTABLISHED. WHEREAS', the City Council desires to maintain a continuous off-street parking program, the objectives of which are to alleviate existing parking problems in the City and to plan for the meeting of parking needs as they occur; and WHEREAS, it is considered advisable in the 'development of such program to establish the Council as the Parking Authority, to transfer administrative control of the parking property inventory to such Authority and to direct the deposit of all revenue accruing to the City from parking facilities to a Parking Authority Fund; and WHEREAS, Section 33.1 of the Charter empowers the City to acquire, operate and maintain off-street parking facilities and the Council is empowered to do any and all acts or things necessary or appropriate to carry out the purposes of providing off-street park- ing facilities. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: SECTION 1. A. The City Council of the City of Bakersfield is hereby estab- lished as the Parking Authority of the Cityof Bakersfield. Bo The establishment of the Council as the Parking Authority shall not be construed as derogating in any way the responsibility or power of the City Council to institute and conduct proceedings under any California Special Assessment Act, including any Parking District Act, or any procedural ordinance of the City, which may be used as methods for the acquisition, construction and maintenance of off-street parking facilities and improvements. SECTION 2. A. The parcels of real property owned or controlled by the City now being used or capable of being used for off-street parking purposes are identified and listed in Exhibit "A", attached hereto and made a part of this resolution. Such exhibit may be amended by adding or eliminating parcels by minute order of the City Council. B. Administrative control of the real property described in said Exhibit "A" is hereby transferred to the Parking Authority, for the purposes of this resolution. SECTION 3. A. A Parking Authority Fund is hereby established. B. All receipts of monies by the City from all properties 1,isted in Exhibit "A", including parking collections and rental or sale thereof shall be deposited in said Parking Authority Fund. C. The City Council may make contributions to the Parking Authority Fund for specified purposes, which contributions shall be deemed to be revenue to the Authority. The City Council may also make loans to such fund to be repaid to the general fund in accord- ance with the terms established by the City Council. D. All expenses, costs and charges, including lease costs, con- tractual obligations, construction maintenance and administrative costs incurred by the City in connection with the properties listed in Exhibit "A", shall be paid out of and from the Parking Authority Fund and all net revenues to be retained in such fund up to a maxi- mum amount of $2,000,000. E. In the event net revenues accrue to said Parking Authority Fund in an amount in excess of $2,000,000, such excess shall be trans- ferred to the general fund of the City. SECTION 4. This resolution shall be effective on and after July 1, 1976. SECTION 5. The City Council reserves the right to amend or repeal this resolution at any time. o0o ..........
