A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD ORDERING THE VACATION OF
THE PEDESTRIAN WALKWAY BETWEEN LOS NIETOS
COURT AND EL TOVAR COURT, SOUTH OF LAS
CRUCES AVENUE, IN THE CITY OF BAKERSFiELD.
WHEREAS, on the 5th day of April, 1976, the Council of
the City of Bakersfield, pursuant to the provisions of the "Street
Vacation Act of 1941," being Division 9, Part 3, of the Streets
and Highways Code of the State of California, passed and adopted
its Resolution of Intention No. 914, declaring its intention to
order the vacation of the pedestrian walkway between Los Nietos
Court and E1 Tovar Court, south of Las Cruces Avenue~ in the City
of Bakersfield; and
WHEREAS, said Council did fix a time and place for hear-
ing all persons interested in or objecting to said proposed vaca-
tion, which said hearing was held on the 3d day of May, 1976, after
notices were duly posted as required by law; and
WHEREAS, this Council after duly considering the matter,
does hereby find and resolve as follows:
1. That the pedestrian walkway between Los Nietos Court
and E1 Tovar Court, south of Las Cruces Avenue, in the City of
Bakersfield, County of Kern, State of California, more particularly
described as follows, is unnecessary for present or prospective
pedestrian walkway purposes:
A pedestrian walkway easement, thirty (30)
feet in width, lying equally on either side
of the lot line between Lots 53 and 54, Tract
3363 in the City of Bakersfield, County of
Kern, State of California, as shown on the
map of said Tract, recorded in Book 19 of
Maps, Page' 145, in the office of the County
Recorder of the County of Kern.
2. That said pedestrian walkway between Los Nietos
Court and E1 Tovar Court, south of Las Cruces Avenue, in the City
of Bakersfield, be and the same is hereby closed up, vacated and
abandoned for pedestrian walkway purposes subject to and in con-
formity with said Resolution of Intention No. 914. Reference to
said Resolution of Intention is hereby made for further particulars.
3. That the notices given and the hearing conducted
also meet the requirements of the Public Service Easements Vaca-
tion Law being Article 5, Division 1 of Title 5 of the Government
Code of the State of California.
4. That City Clerk shall certify to the passage of
this resolution and shall cause a certified copy hereof, attested
by the Clerk under the seal of the City to be recorded in the office
of .the County Recorder of the County of Kern, California.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 3d day of May, 1976, by the following
vote:
