COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PUBLIC UTILITIES EASEMENT BEHIND MONTCLAIR STREET BETWEEN MARSHA STREET AND STOCKDALE HIGHWAY, IN THE CITY OF BAKERSF IELD. WHEREAS, on the 5th day of April, 1976, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Service Easements Vacation Law," being Sections 50430 to 50445, inclusive, of the Government Code of the State of California, passed and adopted its Resolution of Intention No. 913, declaring its intention to order the vacation of public service easements, also referred to herein as public utilities easements, situated in the City of Bakersfield, County of Kern, State of California, and being behind Montclair Street between Marsha Street and Stock- dale Highway, City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 3d day of May, 1976, after notices were duly published and posted as required by law; and WHEREAS, this Council, after duly considering the matter, does hereby find and resolve as follows: 1. That said public service easements also referred to herein as public utilities easements, hereinafter described, are unnecessary for present or prospective public use: A public utilities easement five feet in width lying adjacent to the northwesterly line of Lots 1 thru 6, Tract 3408 in the City of Bakersfield, county of Kern, State of California, -as shown on the m~p of said Tract recorde~ Book 19 of Maps at Page 75 in the offic~ of the County Recorder of the County of Kern. 2. That said public service easements be and the same are hereby vacated and abandoned for public service easement purposes, subject to and in conformity with the reservation of the easements contained in and contemplated by said Resolution of Intention No. 913. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution, and shall cause a certified copy thereof, ~ttested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of Kern County, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 3d day of May, 1976, by the following vote: AYES: COUNCILMEN BARTON, BLEECKER, CHRIS/TNSEN, M[,DDKRS, ROG2RS, SCEALES, SfRONG NOES: COUNCIUj}EN: /,-,y?
