RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD SUPPORTING THE STATE RECLAMATION
BOARD'S DESIGNATED FLOODWAY PROGRAM IN
PRINCIPLE, DETERMINING TO PROVIDE ASSISTANCE
TO THE RECLAMATION BOARD TO CARRY OUT THEIR
OBJECTIVES IN THE CITY OF BAKERSFIELD AND
REQUESTING EXECUTION OF COOPERATIVE AGREEMENT.
WHEREAS, this City Council commends the State of California
Reclamation Board's efforts and action in designating a floodway
and floodway encroachment lines for the Kern River and modifying
the same as conditions change; and
WHEREAS, it is the desire of this Council to cooperate
with the Reclamation Board to the end that land uses will not
materially increase the flood height or the velocity of the design
flood when confined within the encroachment lines; and
WHEREAS, the City of Bakersfield is empowered by its
building code, flood plain ordinance, subdivision ordinance and
state law to prevent the material increase in the flood height or the
velocity of the design flood and thereby minimize damage to the
designated floodway, to property and to life.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Council of
the City of Bakersfield as follows:
1. That the City of Bakersfield supports the Reclamation
Board's Designated Floodway Program in principle and will provide
such assistance to the Reclamation Board as is necessary to carry
out its objectives, in the City of Bakersfield.
2. That the City of Bakersfield desires to carry out a
cooperative floodway program in the City to prevent duplication and
overlapping of administrative enforcement functions and therefore
requests that maximum local control of land use in the floodway
lands be attained by means of a joint exercise of powers agreement
between the Reclamation Board and the City of Bakersfield.
3. That a certified copy of this resolution be trans-
mitted by the City Clerk to the Reclamation Board, Room 335,
Resources Building 11416 - 9th Street, Sacramento, California 95814.

and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 19th day of April , 1976, by the
