HomeMy WebLinkAboutRES NO 22-76RESOLUTION N0. ,22-76 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD OF INTENT TO COMPLY WITH ALL STATE AND FEDERAL REGULATIONS PERTAINING TO SEWER USE ORDINANCE AND REVENUE PROGRAM IN CONNECTION WITH THE CITY 'S APPLICATION UNDER THE CLEAN WATER GRANT PROGRAM. WHEREAS, the City of Bakersfield has applied for a grant under the Clean Water Grant Program to assist in the development of a Wastewater Treatment Project; and WHEREAS, the City is required to develop and implement an appropriate revenue program to assure adequate operation and maintenance of treatment works and necessary replacement and expansion of treatment works together with an approvable sewer use ordinance. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Council of the City of Bakersfield, State of California, as follows: 1. That the City of Bakersfield intends to comply with all state and federal regulations pertaining to a sewer use ordin- ance which are required under the Clean Water Grant Program. 2. That such ordinance which will be adopted shall comply with the following requirements: (a) The ordinance shall prohibit connections of inflow (prohibited substance) sources, to the sanitary sewer system. (b) The ordinance shall ensure that new sewers and connections to the sewer system are properly designed and constructed. (c) The ordinance shall regulate the volume, flow rate, strength and nature of waste discharges to the sanitary sewers to protect the sewerage system from damage and/or operational difficulties and to prevent the introduction of pollutants to the system which would pass through inadequately treated. The ordinance shall require pretreatment for discharges to public sewers of wastes whose characteristics exceed the defined acceptable limits. Further- more, the ordinance' shall reference and enforce Federal pretreat- ment requirements for certain categories of industrial users where they are more stringent. (d) The sewer ordinance or other legislative enact- ment shall establish an equitable system of user charges to defray the costs of operation, maintenance and replacement. Similarly, the ordinance will establish a system of industrial cost recovery which would require all industrial users to pay that .portion of an EPA grant amount allocable to the treatment of wastes from such users. (e) The sewer use ordinance shall be enforceable. 3. That the City of Bakersfield as grantee under the Clean Water Grant Program intends to implement a revenue program which will, through user service charges and connection fees or other approved appropriate means, recover appropriate capital costs and costs of operation and maintenance, and fund reasonable future expansion and improvements as needed. The revenue program to be implemented by the City shall comply with guidelines established by the State Water Resources Control Board and EPA regulations and encompass and reflect the principle that future expansion and improvements will include reasonable replacement or preservation of the functional value of all capital facilities including grant- funded facilities. The revenue program shall assure that industrial waste contributors repay costs properly allocable to the industrial function. Allocation of costs shall be on the basis of volume and character of the user's wastes. The City of Bakersfield shall use revenues accruing to it for wastewater facilities in accordance with the guidelines. It is intended that the revenue program will result in local self-suffiCiency and permit continuation of the clean water effort initiated by the grant program. The revenue program to be implemented shall satisfy the requirements of Federal law and regulations. 4.
