HomeMy WebLinkAboutRES NO 21-76RESOLUTION NO. 21-76 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF KERN TO'ORDER THE CONSOLIDATION OF A SPECIAL MUNICIPAL ELECTION SUBMITTING TO THE ELECTORS OF THE CITY CERTAIN PROPOSED REVISIONS TO THE CITY CHARTER WITH THE STATE OF CALIFORNIA DIRECT PRIMARY ELECTION AND PRESIDENTIAL PRIMARY ELECTION TO BE HELD ON TUESDAY, JUNE 8, 1976, SETTING FORTH THE EXACT FORM OF THE MEASURES TO BE VOTED UPON AT SUCH ELECTION AS THE SAME ARE TO APPEAR ON THE BALLOT AND PROVIDING FOR THE CONSOLIDATION OF SUCH CHARTER REVISION ELECTION WITH THE MAYORALTY ELECTION AND THE ELECTION SUBMITTING TO REFERENDUM AN ORDINANCE CHANGING THE SALARY OF MEMBERS OF THE COUNCIL. WHEREAS, Section 23302 of the Elections Code of the State of California provides that whenever an election called by a city for the submission of any proposition is to appear upon the same ballot as that provided for a statewide election, the City shall, at least 74 days prior to the date of the election, file with the Board of Supervisors, and a copy with the County Clerk, a resolution of its governing body requesting such consolidation and setting forth the exact form of any questions or propositions to be voted upon at such election, as the same are to appear on the ballot; and WHEREAS, on the 15th day of March, 1976, this Council did pass and adopt Resolution No. 20-?6 , calling a Special Municipal Election to be held in the City of Bakersfield on Tuesday, the 8th day of June, 1976, for the purpose of submitting to the qualified electors of said City, certain proposed amendments or revisions to the Charter of the City of Bakersfield; and WHEREAS, it is the desire of this Council that said Special Municipal Election be consolidated wi~hthe State of California Direct Primary Election and Presidential Primary Election to be held on Tuesday, the 8th day of June, 1976. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That the Board of Supervisors of the County of Kern is hereby requested to make an order, pursuant to Section 23302 of the Elections Code of the State of California, consolidating the Special Municipal Election called by the Council of the City of Bakersfield for the purpose of submitting to the qualified electors of the City, certain proposed amendments to the Bakersfield City Charter, for June 8, 1976, with the State of California Direct Primary Election and Presidential Primary Election to be held on the same date. 2. That the form of the City of Bakersfield measures to be voted upon at said election, as the same are to appear on the ballot, are as follows: MEASURE "B" Shall Section 67 of the Charter of the City of Bakersfield be amended to provide for a General Yes Election for Councilmen to be held on the first Tuesday after the first Monday in March of each odd-numbered year commencing in 19777 Such General Election will coincide with the various School Board Elections and the single candidate receiving the highest number of votes being No declared the winner without runoff. MEASURE "C" Shall Section 67 of the Charter of the City of Bakersfield be amended to provide for a Nominat- ing Election for Councilmen to be held on the Yes first Tuesday after the first Monday in March and a General Election for Councilmen to be held on the last Tuesday in May, of each odd- number year commencing in 19777 Such Nominat- ing Election will coincide with the various School Board Elections and the General (Runoff) No Election may or may not coincide with any other scheduled election. 3. That said Board of Supervisors is further requested to provide that within the City of Bakersfield, the election precincts, polling places and voting booths shall, in every case, be.the same and there shall be only one set of election officers in each of the precincts established in the City for said Special Municipal Election and'the Consolidated State of California Direct Primary Election and the Presidential Primary Election and that the exact form of the measures to be voted upon shall be as set forth in each ballot to be used at said Special Municipal Election within the City of Bakersfield. 4. Said Board of Supervisors of Kern County is further requested to cause said measures to be printed upon each of the ballots to be used in the City of Bakersfield at said Special Municipal Election consolidated as requested, within the City, including absent voter ballots. Said Board is further requested to cause to be set forth said measures on all sample ballots relating to said Special Municipal Election (as for other City elections called and consolidated) and to mail to the qualified electors within the City said sample ballots and voters pamphlets and argu- ments, if any, relating to said Special Municipal Elections, all in the time and in the form required by law and to provide absent voter ballots for said consolidated elections for use by qualified electors of the City of Bakersfield who may be entitled thereto, in the manner provided by law. 5. That the Board of Supervisors of the County of Kern is hereby authorized to canvass or cause to be canvassed the returns of said Special Municipal Election in the City of Bakersfield, and are requested to certify the results of the canvass by said returns to the Council of the City of Bakersfield, who shall thereupon declare the results thereof. 6. That the Mayoralty Election and the Referendum elec- tion are hereby consolidated with the Special Municipal Election Submitting Charter Amendments to the Electors. 7. That the City Clerk is hereby directed to transmit and file certified copies of this resolution with the Board of Supervisors of Kern County and the County Clerk of Kern County, as required by Section 23302 of the'Elections Code of the State of California.
