HomeMy WebLinkAboutRES NO 78-75RESOLUTION NO. 781-75 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF INYO STREET LYING BETWEEN TRUXTUN AVENUE AND E. 18TH STREET, IN THE CITY OF BAKERSFIELD. WHEREAS, on the-~7th ~ay Of'Oc~gber,.1975, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California., passed and adopted its Resolution of Intention No. 909a declaring its intention to order the vacation of a portion of Inyo street lying between Truxtun Avenue and E. 18th Street, in the City of Bakersfield; and WHEREAS, said Council did fix a time and place for hear- ing all persons interested in or objecting to said proposed vacation, which said hearing was held on the-i7thday of N~Vember, 1975, after notices where duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that portion of.Inyo Street lying between Truxtun Avenue and E. 18th Street, in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: A portion of the former Town of Kern, now within the City of Bakersfield, as shown on that map filed on January 12, 1889, in the office of the County Recorder of the County of Kern, in Book 1 of Maps, Pages 15 and 16, and also being a portion of Section Twenty-Nine (29), Township Twenty-Nine (29) South, Range Twenty-Eight (28) East, Mount Diablo Meridian, more particularly described as follows: Inyo Street, 80.00 feet in width, between the extension of the southerly right-of-way line of "F" Street (now East 18th Street) as shown on said map of Kern, and the northerly boundary of that portion of Inyo Street vacated by the City of Bakersfield in Resolution N6.81-71 on November 1, 1971. An easement for public utilities, water and alarm system for fire suppression, and sewers shall be retained within the above-described area and shall be kept free of buildings or structures of any type. 2. That said portion of Inyo Street lying between Truxtun Avenue and E. 18th Street, in the City of Bakersfield, be and the same is hereby closed up, vacated and abandoned for public street purposes subject to and in conformity with said Resolution oflntention No. 909a. Be it further provided that said vacation be subject to a dedication and construction of an alley from the present alley in Block 143 north to 18th Street with a width and turn radius acceptable to the Department of Public Works of the City of Bakersfield. 3.
