HomeMy WebLinkAboutRES NO 48-75RESOLUTION NO. .48-75 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, STATE OF CALIFORNIA, CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY OR WELFARE REQUIRE FORMATION OF AN UNDERGROUND UTILITY DISTRICT WITHIN DESIGNATED AREA. WHEREAS: (a) Chapter 12.27 of the Municipal Code of the City of Bakersfield establishes a procedure for the creation of underground utility districts, and requires, as the initial step in such procedure, the declaration and holding of a public hearing to ascertain whether the public necessity, health, safety or general welfare require the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, coranunication, cable television or similar and associated services in any such district; and (b) The Planning Commission of the City of Bakersfield on July 2, 1975, at its regular meeting thereof, recommended that an underground utility district, hereinafter called Underground Utility District No. 4, be formed in that area in the City, more particularly described as follows: Underground Utility District No. 4 That area in the City of Bakersfield, State of California, more particularly described as follows: Beginning at the intersection of the east right-of-way line of "Q" Street and the north right-of-way line of Truxtun Avenue; Thence (1) easterly along the north right-of-way of Truxtun Avenue a distance of 66 feet to the southeast corner of Lot 5, Block 293, City of Bakersfield; Thence (2) northerly along a line 66 feet east of and parallel to the east right-of-way line of "Q" Street to the northeast corner of Lot 5, Block 213, City of Bakersfield; Thence (3) westerly along the north line of said Lot 5 to the east right-of-way line of "Q" street; Thence (4) northerly along the east right-of-way line of "Q" Street to intersect the south line of the north 72 feet of Lot 4, Block 186, City of Bakersfield; Thence (5) easterly along the last-named south line a distance of 66 feetto the east line of said Lot 4; Thence (6) northerly along a line 66 feet east of and parallel to the east right-of-way line of "Q" street to the south line of Lot 4, Block 173, City of Bakersfield; Thence (7) westerly along the last-named south line to the east right-of-way line of "Q" Street; Thence (8) northerly along the east right-of-way line of "Q" Street to the southwest corner of Lot 1, Block 146, City of Bakersfield; Thence (9) westerly along the extended south line of said Lot 1 to the west right-of-way line of "Q" Street; Thence (10) southerly along the west right-of-way line of "Q" Street to the southeast corner of Lot 10, Block 172, City of Bakersfield; Thence (11) westerly along the south line of said Lot 10 a distance of 66; Thence (12) southerly along a line 66 feet west of and parallel to the west right-of-way line of "Q" Street to the south right-of-way line of 20th Street; Thence (13) easterly along the south right-of-way line of 20th Street to the west right-of-way line of "Q" Street; Thence (14) southerly along the west right-of-way line of "Q" Street to the north right-of-way line of 18th Street; Thence (15) westerly along the north right-of-way line of 18th Street a distance of 55.33 feet; Thence (16) southerly along a line 55.33 feet west of and parallel to the west right-of-way line of "Q" Street to the south right-of- way line of 17th Street; Thence (17) easterly along the south right-of-way line of 17th Street to the west right-of-way line of "Q" Street; Thence (18) southerly along the west right-of-way line of "Q" Street to a point 30 feet south of the south right-of-way line of Truxtun Avenue; Thence (19) easterly, along a line 30 feet south of and parallel to the south right-of-way line of Truxtun Avenue, to the east right-of- way line of 'Q" Street; Thence (20) northerly along the east right-of-way line of "Q" Street to the north right-of-way line of Truxtun Avenue, being the point of' beginning for this description. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Bakersfield as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by and before the City Council of the City of Bakersfield, on the 8th day of September, 1975, at the hour of 8 P. M. in the Council Chambers of the City Hall at 1501 Truxtun Avenue, Bakersfield, California, to ascertain whether the public necessity, health, safety or welfare require the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, cable television or similar and associated services in Underground Utility District No. 4, hereinabove described. 2. NOTICE IS FURTHER GIVEN that should District No. 4 be formed, all existing overhead communication and electric distri- bution facilities therein shall be removed in accordance with the provisions of Chapter 12.27 of the Municipal Code of the City of Bakersfield and the Resolution intended and proposed to be adopted, establishing such District No. 4; that each property owner within such district, served from such overhead distribution facilities, will be required to provide, in accordance with the rules of the Public Utilities Commission of the State of California for under- ground service, all changes on his premises necessary to receive service from the underground installation of utilities when made available; that each property owner, if not in possession of the affected property, shall notify the occupant thereof; and that the Utilities (as defined in Chapter 12.27 of the Municipal Code) supplying electric, communication, cable television or similar service, will be authorized to discontinue all overhead services. 3. NOTICE IS FURTHER GIVEN that at such hearing all persons interested shall be given an opportunity to appear and be heard. Said hearing may be continued from time to time as may be determined by the City Council, whose decision shall be final and conclusive. 4. That the City Clerk shall notify all affected property owners as shown on the last equalized assessment roll, and the Utility Companies (Utilities), of the time and place of ,such hearing by mailing a copy of this Resolution to such property owners, and Utilities concerned, at least ten (10) days prior to the date of such hearing. 5.
