HomeMy WebLinkAboutRES NO 46-75CITY COUNCIL OF THE.' dITY OF BAKERSFIELD RESOLUTION NO'. 46-75 RESOLUTION FINDING AND DETERMINING THAT A SUB- SEQUENT ENVIRONMENTAL IMPACT REPORT NEED NOT BE PREPARED FOR THE PROPOSED SALE AND DEVELOP- MENT OF CERTAIN REAL PROPERTY IN THE DOWNTOWN BAKERSFIELD REDEVELOPMENT PROJECT WHEREAS, the Bakersfield Redeyelopment Agency (the "Agency"), as the lead agency, has c~rtified, approved, and adopted the Envirot:~lental Impact Report (the "EIR") for the Downtown Bakers- field Redevelopmerit Project (the "Project"l) by Resolution No. RA31-74 on November 18, 1974; and WHEREAS, this City Council,.as the'responsible agency, has certified, approved, and adopted said EIR for the Project pursuant tothe provisions of Ordinance No. 2216, which on November 25, 1974 adopted the Amended Redevelopment Plan for the P~oject; and WHEREAS, pursuant to the California Environmental Quality Act, all public and private activities or undertakings pursuant to or in furtherance of the Amended Redevelopment Plan for the Project are deemed. to be a single project, and the certifica- tion, preparation and adoption of the EIR for the Project pre- cludes the necessity of certifying, preparing, and adopting further and subsequent environmental impact reports for any such public and private activities and undertakings in the Project; and WHEREAS, in order to pursue and further the Amended Redeve- 'lopment Plan, the Agenqy proposes to sell certain real property (the "property") in the Project generally described as the south- west corner of 17th and "L" Streets pursuant to the terms and provisions of a "Disposition and Development Agreement" proposed to be entered ~nto with the partnership of James Aloe Weston, Trustee and Julian Weston (the "Developer") as the purchaser and developer of the Property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAKERSFIELD AS FOLLOWS: The City Council hereby finds and determines that the envi- ronmental impacts related to the development of the Property, pursuant to the proposed Disposition and Development Agreement to be entered into between the Agency and the Developer, were considered under the circumstances presented in the Environmental Impact Report for the Downtown Bakersfield Redevelopment Project, and that, therefore, a subsequent environmental impact report need not be prepared thereto. o0o I HEREBY CERTIFY that the foregoing resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 28th day of July, 1975, by the following vote: AYES: COUNCILMEN BARTON, BLEECKER, .CHRIg TI:NgEt% MEDDERS, ROGERS, SCEALES, STRONG NOES: COUNCILMEN: ABSENT COUr~CiL~AEN: A_BSTAIN~NG COUNCILMEN: ~Iouncil of the C~akersfield APPROVED as tO ~6~m: the CITY ATTORNEY of,,/fhe City of Bakersfield
