ARESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD, INDICATING THE BUILDING PERMIT
SYSTEM WHICH THE CITY HAS ADOPTED ~ND THE
REVIEW PROCEDURE FOR THE SYSTEM.
WHEREAS, the City of Bakersfield has adopted Title 13
of the Municipal Code cited as the "Buildings and Construction
Code" in order to promote the public safety and welfare by the
adoption of minimum building standards required and enforced
throughout the territory of the City of Bakersfield; and
WHEREAS, by Section 13.16,010 of said Buildings and
Construction Code, this City Council adopted by reference pursuant
to State of California law, the Uniform Building Code, 1973 Edition,
which Code was sponsored and copyrighted by the International Con-
ference of Building Officials, and Standards including the appendix
thereto and is presently enforcing such Code; and
WHEREAS, Section 301(a) of said Uniform Building Code
prohibits any person, firm or corporation from erecting, construc-
tion, enlarging, altering, repairing, moving, improving, removing,
converting or demolishing any building or structure in the City of
Bakersfield or causing the same to be done, without first obtaining
a separate building permit for each such building or structure from
the Building Official; and
WHEREAS, the Building Director must examine all plans
and specifications for the proposed construction when application
is made to him for a building permit; and
WHEREAS, on August 7, 1974, the City Council, by ordin-
ance, added Section 2316 to said Uniform Building Code, which
section requires the Building Director to review applications for
building permits, including the plans and specifications for the
proposed construction, to determine if the proposed construction
is consistent with the need to minimize flood damage and orders
said Building Director to require that proposed construction in
flood hazard locations be designed and anchored to prevent the
flotation, collapse or lateral movement of the structure or por-
tions of the structure due to flooding; to require the use of
construction materials and utility equipment that are resistant
to flood damage; to require the use of construction methods and
practices that will minimize flood damage; to require that the
builder provide adequate drainage in order to reduce exposure to
flood hazards; to require the location of public utilities and
facilities on the site in such a manner as to be elevated and
constructed to minimize or eliminate flood damage. Under said
Section 2316, if in the opinion of the Building Director, a
structure to be used for human habitation or occupancy is proposed
to be located such that it would be subject to flood hazard or mud
slide, to the extent that it would endanger human life or safety,
a permit to ~nstruct' shall be denied, unless corrective work
satisfactory to the Building Director can be done to eliminate or
sufficiently reduce the hazard.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. That the Building Director of the City of Bakersfield,
when reviewing applications for building permits, including the plans
and specifications for the proposed construction, will review all
building permit applications to determine if the proposed construction
is consistent with the need to minimize flood damage.
2. That the Building Director shall review all building
permit applications to determine if the site of the proposed con-
struction is reasonably safe from flooding and to make recommendations
for construction in all locations which have flood hazards.
3. That the Building Director in reviewing all applica-
tions for construction in flood hazard locations within the City
shall require that any such proposed construction must:
a. Be designed and anchored to prevent the flotation,
collapse or lateral movement of the structure or portions of the
structure due to flooding.
b. Use of construction materials and utility equip-
ment that are resistant to flood damage.
c. Use of construction methods and practices that
will minimize flood damage·
d. Provide adequate drainage in order to reduce
exposure to flood hazards.
e. Locate public utilities and facilities on the
site in such a manner as to be elevated and constructed to minimize
or eliminate flood damage, such utilities and facilities including
sewer, gas, electrical and water systems·
4. IT IS FURTHER RESOLVED that the Planning Commission
and/or the City Engineer of the City of Bakersfield in reviewing
subdivision applications shall make findings of fact where indicated
and determine if:
a. All such proposed developments are consistent with
the need to minimize flood damage.
b. Adequate drainage is provided so as to reduce
exposure to flood hazards.
c. Adequate drainage is provided so as not to increase
the exposure to flood hazards of adjacent lands.
d. All public utilities and facilities are located,
elevated and constructed so as to minimize or eliminate flood
damage, these utilities and facilities to include gas, electrical
and water systems.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 14th day of July , 1975,
