HomeMy WebLinkAboutRES NO 39-75RESOLUTION NO. :'39-75 RESOLUTION OF THE COUNCIL OF THE CITY OF' BAKERSFIELD ORDERING THE VACATION OF A PORTION OF SACRAMENTO STREET LYING BETWEEN EAST 21ST AND GROVE STREETS, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 19th day of May, 1975, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 906, declaring its intention to order the vacation of a portion of Sacramento Street lying between East 21st and Grove Streets, in the City of Bakersfield; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 9th day of June, 1975, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that portion of Sacramento Street lying between East 21st and Grove Streets, situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: Those portions of the City of Bakersfield that are shown on that Map of Kern, Kern County, California, recorded in the Office of the County Recorder of the County of Kern in Book 1 of Maps, Page 53, dated April 10, 1893, more particularly described as follows: That portion of Sacramento Street, being 80 feet in width, lying between Lot 1 of Block 114, and Lot 16 of Block 113, and that portion lying between Lot 32 of Block 114 and Lot 17 of Block 113; excepting and reserving for public utilities purposes the easterly 30 feet of said closing, said easement to be kept free and clear of any buildings or structures. 2. That said portion of Sacramento Street lying between East 21st and Grove Streets in the City of Bakersfield be and the same is hereby closed up, vacated and abandoned for public street purposes subject to and in conformity with said Resolution of Intention No. 906. Reference to said Resolution of Intention is hereby made for further particulars. 3.
