HomeMy WebLinkAboutRES NO 11-75RESOLUTION NO. 11-75 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE ALLEY IN BLOCK 283, BOUNDED BY TRUXTUN AVENUE, "G" STREET, 17TH STREET AND "H" STREET, CITY OF BAKERSFIELD. WHEREAS, on the 27th day of January, 1975, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 904, declaring its inten- tion to order the vacation of the alley in Block 283, bounded by Truxtun Avenue, "G" Street,. 17th Street and "H" Street,'situate in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hear- ing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 24th day of February, 1975, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That the alley in Block 283, bounded by Truxtun Avenue, "G" Street, 17th Street and "H" Street, situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: A parcel of land situate in the city of Bakersfield, County of Kern, State of California, being a portion of Section 25, T.29 S., R.27 E., M.D.B.& M. and more particularly described as follows: All of the alley, 33 feet in width, in Block 283 as shown on the Map of the City of Bakersfield filed in the Office of the County Recorder of said Kern County in Book 1, Pages 13-14, on November 25, 1898. Excepting and reserving for public utilities purposes the northerly 10 feet of said alley for placing and maintaining an underground plant, a pole line (surface) easement over the easterly 100 feet of said 10 foot easement and an overhanging wires (aerial) easement over the remaining length of the alley, with the above-mentioned easterly 100 feet being kept free and clear of all buildings and structures to provide for vehicular access, also, reserving a sewer line easement 10 feet in width on center line of said alley. 2. That said alley in Block 283, bounded by Truxtun Avenue, "G" Street, 17th Street and "H" Street, be and the same is hereby closed up, vacated and abandoned for public street pur- poses, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 904. Reference to said Resolution of Intention is hereby made for further particulars. 3.
