HomeMy WebLinkAboutRES NO 79-74RESOLUTION NO. 79-74 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD FINDING AND DECLARING THAT A MAJORITY PROTEST WAS MADE AND DECLARING PRO- CEEDINGS FOR ANNEXATION TO CITY OF CERTAIN INHABITED TERRITORY DESIGNATED AS "UNION AVENUE NO. 6" ARE TE'RMINATED UNDER SECTION 35121.1 OF GOVERNMENT CODE. WHEREAS, the Local Agency Formation Commission of Kern County has designated Union Avenue No. 6 as Annexation No. 217 and Proceeding No. 405, and by Resolution No. 73-43 approved the pro- posal for annexation; and WHEREAS, on September 23, 1974, at the continued public hearing before the Council for hearing protests by persons owning real property, evidence was presented that petitions, signed by 55% of the land value of the territory sought to be annexed, protested the annexation; and WHEREAS, Section 35121.1 of the Government Code states that if a resolution finding and declaring that a majority protest is made is adopted, no further proceedings for the annexation of the same territory to the City shall be taken for one year after the date of the adoption of the resolution, except upon the petition or consent of all property owners of the territory proposed to be anne xe d. NOW, THEREFORE, IT IS HEREBY FOUND, DECLARED AND ORDERED AS FOLLOWS: 1. That a majority protest has been made in City of Bakers- field Annexation No. 217 (Union Avenue No. 6), LAFCO Proceeding No. 405. 2.
