HomeMy WebLinkAboutRES NO 61-74 RESOLUTION NO. 61-74 A RESOLUTION AND ORDER OF THE COUNCIL OF THE CITY OF BAKERSFIELD CALLING A SPECIAL MUNICIPAL ELECTION FOR TUESDAY, NOVEMBER 5, 1974 FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY CERTAIN AMENDMENTS TO THE CHARTER OF THE CITY OF BAKERSFIELD. WHEREAS, the Council of the City of Bakersfield proposes to submit certain amendments to the Charter of the City of Bakers- field to the electors of said City, in the manner set forth in Chapter 3, Division 2 of Title 4 (commencing with Section 34450) of the' Government Code of the State of California, at a Special Municipal Election to be held in the City of Bakersfield and to be consolidated with the State of California General Election to be held on Tuesday, the 5th day of November, 1974; and WHEREAS, the Charter Amendments so proposed to be submitted are as follows: Measure "A'_-' That Section 18 of the Bakersfield City Charter be amended to read as follows: Salary of Councilmen Section 18. Commencing with the fiscal year 1974-1975, the salaries of councilmen shall be equal to the amount of monthly salary established for councilmen in general law cities by Section 36516(d) of the Government Code, as amended in 1972, to wit: $300 per month; and such salaries shall be made equal to the amount of salary estab- lished for councilmen in general law cities by any amendment to such statute. Compensation of councilmen may be increased beyond the amount provided in said Section 36516(d) or decreased below such amount by an affirmative vote by the majority of the electors of the City voting at any municipal election. Measure "B" That subsection (c) of Section 20 of the Bakersfield City Charter be amended to read as follows: (c) The Mayor shall devote such time as may be necessary to properly and efficiently discharge the duties of his office, and shall receive such salary as shall be prescribed by the City Council, pro- vided such salary shall be not less than six thousand dollars ($6,000) annually. At the beginning of each fiscal year, the Council shall appropriate a sum of money, not less than fifteen hundred dollars ($1,500), sufficient for the reception and entertainment of public guests by the Mayor. Measure "C" That Sections (194)12 and (229)9 of the Bakersfield City Charter be amended to read as follows: Chief of the Fire Department Section (194)12. The Chief of the Fire Department shall be appointed by the City Manager. Such appointment need not be made from among the members of the Bakersfield Fire Department. After appoint- ment, the Fire Chief shall be removed or reduced in rank only as pro- vided for other members of the classified service. The dismissal of the Chief of the Fire Department from the office, by the City Manager, shall not accomplish his dismissal from the Department, and upon such dismissal, he shall be restored to the rank and grade held by him prior to his appointment as Chief of the Fire Department. Appointment of Chief of Police Section (229)9. The Chief of Police shall be appointed by the City Manager. Such appointment need not be made from among the members of the Bakersfield Police Department; after appointment, the Chief of Police shall be removed from office or reduced in rank only as provided by this article. Measure That subsection (a) is added to Section (194)12, and Section (208)1 of the Bakersfield City Charter is amended to read as follows: Removal of Fire Chief Section (194)12(a). The Chief of the Fire Department shall not belong to the classified service and shall not be under the juris- diction of the Civil Service Board° He may be removed, suspended or reduced in rank, for cause, solely by the City Manager; any provision in this section or article to the contrary, not withstanding. This subsection shall become operative when the first vacancy arises in the office of Fire Chief subsequent to the effective date of this amendment. The incumbent, at the time of such effective date, shall be subject to and shall have the benefit of this section as it existed prior to the effective date of this amendment. Creation and Establishment of Civil Service Section (208)1. There is hereby created and established Civil Service for all employees of the City of Bakersfield in the miscellaneous departments, excepting elective officers, the City Manager, Deputy City Manager, Assistant City Manager, all department heads, and members of all boards and commissions, which shall be known and designated as "Civil Service for Employees in the Miscel- laneous Departments." The above-mentioned excepted officers and employees shall not belong to the classified service, and shall not be under the jurisdiction of the Civil Service Board. They may be removed or suspended for cause, solely by their appointing authority and pursuant to law; any provisions in this Charter to the contrary, notwithstanding. This section shall become operative when the first vacancy arises in the offices and positions added herein by this amendment, as exceptions to Civil Service, subsequent to the effec- tive date of this amendment. The incumbent at the time of such effective date shall be subject to and shall have the benefit of this section as it existed prior to the effective date of this amendment. NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Council of the City of Bakersfield as follows: 1. That the above-stated propositions to amend the Charter of the City of Bakersfield are hereby submitted for placement on the ballot in proper form to be used as said Special Municipal Election. 2. That a Special Municipal Election is hereby called to be held in the City of Bakersfield on Tuesday, the 5th day of November, 1974, to be consolidated with the State of California General Election, all for the purpose of submitting to the qualified electors of said City the foregoing proposed Charter amendments. 3. That the polls shall be open in all precincts in the City from 7 A.M. to 8 P.M. 4.
