A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAKERSFIELD AUTHORIZING THE CITY
ATTORNEY AND SPECIAL COUNSEL TO BRING A
CIVIL ACTION FOR AND ON BEHALF OF AND IN
THE NAME OF THE CITY.
BE IT RESOLVED by the City Council of the City of
Bakersfield as follows:
Section 1.
The City Attorney and special counsel for the City, Helm
& Budinger, are hereby authorized and directed to commence and
prosecute an action in the Superior Court of the State of California,
in.and for the County of Kern, for and on behalf of the City, and
in the name of the City, and as a representative of other property
owners within the City, for the adjudication and determination of
water rights of the Kern River, declaratory relief, quiet title,
injunction and for damages.
Section 2.
The action herein authorized may be brought in conjunction
and as a co-plaintiff with California Water Service Company.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 28th day of September, 1970,
by the following vote:
