A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD DETERMINING AND DECLARING THAT
THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY
OF THE CITY OF BAKERSFIELD REQUIRE AND DEMAND
THE ACQUISITION OF CERTAIN WATER AND WATER
RIGHTS IN THE KERN RIVER, TOGETHER WITH THE
PRIVILEGE AND RIGHT OF TAKING THE SAME INTO
POSSESSION, TO BE USED BY THE CITY FOR A WATER
SUPPLY| AND DECLARING THE INTENTION OFTHE CITY
OF BAKERSFIELD TO ACQUIRE SAID PROPERTY UNDER
EMINENT DOMAIN PROCEEDINGS, AND DIRECTING THE CITY
ATTORNEY OF THE CITY OF BAKERSFIELD AND SPECIAL
COUNSEL TO COMMENCE AN ACTION IN THE SUPERIOR
COURT OF THE STATE OF CALIFORNIA, IN AND FOR THE
COUNTY OF KERN, FOR THE PURPOSE OF ACQUIRING SAID
WATER AND WATER RIGHTS, TOGETHER WITH THE PRIVILEGE
AND RIGHT OF TAKING SAME INTO POSSESSION.
BE IT RESOLVED b~ the City Council of the City.of
Bakersfield as follows:
Section 1.
The public interest, convenience and necessity of the
City of Bakersfield and the inhabitants thereof require the
acquisition of the first seventy-seven thousand acre ~feet per year
of water and water rights of the Kern River, within Kern County,
California, together with the privilege and right of taking the
same into possession.
S~ction 2.
The public interest, convenience and necessity of said
City and the inhabitants thereof demand the acquisition of said
water and water rights and the taking of the waters thereunder into
possession, for municipal purposes, for the water supply of the
City and its inhabitants.
Section 3.
The property to be condemned is described as the first
seventy-seven thousand acre feet annually of the waters and water
rights of the Kern River, within Kern County, California, together
with the privilege and right of taking the same into possession.
Section 4.
The taking and acquiring by said City of the property
hereinbefore described is deemed necessary for the water supply
of the City of Bakers field and the inhabitants thereof for a
municipal purpose; such use is a public use, and that for such
public use it is necessary that the City of Bakers field condemn
and acquire said property; said property is to be used for the water
supply of said City and its inhabitants.
Section 5.
The City Attorney of the City of Bakers field and special
counsel for thee City, Helm & Budinger be, and they are hereby
authorized and directed to commence an action in the Superior Court
of the State of California, in and for the County of Kern, in the
name and on behalf of the City of Bakersfield, against all owners
and claimants of the above-described property, for the purpose of
condemning and acquiring said property for the said use of said
City.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 28th day of September, 1970,
by the following vote:
