HomeMy WebLinkAboutRES NO 62-70RESOLUTION NO. 62-70 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PUBLIC UTILITIES EASEMENT ALONG TRACT NO. 3250, CITY OF BAKERSFIELD. WHEREAS, on the 17th day of August, 1970, the Council Of the City of Bakersfield, pursuant to the provisions of the "Public Service Easements Vacation Law't, being Sections 50430 to 50445, inclusive, of the Government Code of the State of California, passed and adopted its Resolution of Intention No. 856, declaring its intention to order the vacation of a public service easement, also referred to herein as a public utilities easement, situated in the City of Bakersfield, County of Kern, State of California, and being along Tract No. 3250, situate within the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 14th day of September, 1970, after notices were duly published and posted as required by law; and WHEREAS, this Council, after duly considering the matter, does hereby find +and resolve as follows: 1. That said public service easement also referred to herein as public utilities easement, hereinafter described, is unnecessary for present or prospective public use: All that portion of the five foot public utilities easement lying along the north line of Tract No. 3250 as said Tract No. 3250 is shown on that map recorded January 2, 1970 in Book 18 of Maps at pages 182 and 183, Kern County Records, lying between the west line of Lot 1 of said Tract No. 3250 and the east line of Lot 16 of said Tract No. 3250. 2. That said public service ~asement be and th~ same is hereby vacated and abandoned for public service easement purposes, subject to and in conformity with the reservation of the easement contained in and contemplated by said Resolution of Intention No. 856. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution, and shall cause a certified copy thereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of Kern County, California. o0o ..........
