A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS AND DETERMINA-
TIONS THAT OWNERS OF MORE THAN 60% OF THE
AREA WITHIN THE BOUNDARIES OF THE PROPOSED
PUBLIC IMPROVEMENT DISTRICT NO. 854 HAVE
SIGNED WRITTEN PETITIONS FOR SPECIFIED
IMPROVEMENTS AND WAIVING ALL PROCEEDINGS
REQUIRED BY THE SPECIAL ASSESSMENT INVES-
TIGATION, LIMITA%ION..L~ AND MAJORITY PROTEST
ACT of 1931.
WHEREAS, the City Council at its regular meeting of
June 18, 1970, received and placed on file the Ci~-y Engineer's
Certificate of Sufficiency, and the petitions from residents
along Ralston Street, Murdock Street and Virginia Avenue between
Owens Street and Lakeview Avenue requesting the City Council to
form a Public Improvement District for the construction of curbs,
gutters, sidewalks, driveway approaches and necessary drainage
facilities; and
WHEREAS, the City Council desires in accordance with
said request to initiate proceedings under the Improvement Act
of 1911, (commencing with Section 5000, Streets and Highways
Code) for the construction of said improvements.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that:
1. The foregoing recitals are true and correct and the
City Council so finds and determines.
2. From the very nature of the requested improvements
the City Council finds and determines that the public interest,
convenience and necessity requires their construction.
3. The City Council finds and determines that said
petitions filed with the ~ity Clert~ 6f the Ci~ ~f B~k~r~field',
who is the Ex-Officio Clerk of the City Council of said City,
the Legislative body undertaking said proceedings, have been
signed by the owners of more than sixty per cent (60%) in area
of all of the property subject to assessment for the cost of
the proposed improvement work hereinafter described and hereby
grants said petition requesting said work and deterrf, ines that
the investigation and other requirements provided by the Special
Assessment Investigation, Limitation and Majority Protest Act
of 1931 have been waived in connection with said improvement
work by virtue of the provisions of subsections (2) and (3) of
Section 2804 of the Streets and Highways Code.
4. Said improvement work and construction to be done
in the City of Bakersfield described as follows:
The construction of curbs, gutters, sidewalks,
driveway approaches and necessary drainage
facilities adjacent to Lots 1 through 90,
Tract No. 1171, Lots 88 through 131, Tract
No. 1232, and the south 135 feet of the block
bounded by Owens, Murdock, Robinson Street
and Virginia Avenue, in the City of Bakers-
field, California
5. All of said work to be done within the Improvement
District shown on the map attached and marked "Exhibit B" and
described in the boundary description marked "Exhibit A."

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 6th day of July, 1970,

PUBLIC IMPROVEMENT DISTRICT NO. 854
Beginning-at the intersectionof the Centerline of Owens Street and the
westerly extension of the north line of Lot 88, as said Street and lot are
shown on Tract No. 1232, filed for record May 11, 1944 in Book 5 of Maps,
Page 76, Records of Kern County, State of California;
Thence (1) easterly along the last named westerly extension and along the
north line of Lots 88 through 98., said Trac~ No. 1232, and also along
the north line and extension thereof of Tract No. 1171 as said Tract
No. 1171 is shown on a map recorded in Book 5 of Maps, Page 40, Records
of Kern County, State of California, to intersect the centerline of
Lakeview Avenue (formerly Cottonwood Road), said Cottonwood Road being
as shown on said Tract No. 1232;
Thence (2) southerly along the centerline of said Cottonwood Road to inter-
sect the centerline of Virginia Avenue,'as said Virginia Avenue is shown
on the map of said Tract No. 1171; ·
Thence (3) westerly along said centerline of Virginia Avenue to intersect
the centerline of said Owens Street;
Thence.(4) northerly along the centerline of said Owens Street to the'point
of beg nning for this description.
