HomeMy WebLinkAboutRES NO 14-70RESOLUTION NO. !14-7,0 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT CERTAIN TERRITORY DESIGNATED AS "CALIFORNIA AVENUE NO. 2", AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexation of certain unincorporated territory, designated as "CALIFORNIA AVENUE NO. 2", to the City of Bakersfield; and WHEREAS, all of said territory lies outside the Greater Bakersfield Separation of Grade District; and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a 'part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a 'part of the district to the same extent as such city; except such portion or 'portions thereof which the City Council has determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedings, is as follows: Description of parcels of land to be annexed to the City of Bakers- field designated as California Avenue No. 2. PARC~L--N~.--1; A 'parcel of land situate in the County of Kern, State of California and being a portion of the SE 1/4 of Section 34, Townshi'p 29 South, Range 27 East, M.D.B. & M. Commencing at the southwest corner of the SE 1/4 of said Section 34; Thence (1) northerly along the west line of the SE 1/4 of said Section 34 to intersect the north line of the south 546.feet of said Section 34, said intersection being also the southwest corner of that certain parcel of land as described in a deed recorded July 10, 1963 in Book 3623, Page 963, Official Records of said Kern County; Thence (2) S 89°02'51"E along the last named north line being also along the south line of the last named 'parcel of land, a distance of 360.50 feet to a point which is the westerly terminus of Course 33.of the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1748, New Series; Thence (3) S 89°02'51"E along Course 33 of the last named Corporate Boundary a distance of 348.19 feet to a point which is the southeast corner of the last named parcel of land, being the true 'point of beginning for this description; Thence (4) departing from said Corporate Boundary, N 0°57'09"E along the east line of the last named parcel of land a distance of 400 feet; Thence (5) easterly along a line 'parallel to the south line of said Section 34 a distance of 575', more or less, to intersect the Corporate Boundary of the City of Bakersfield as defined by Course 32 of the boundary description of said Ordinance No. 1748, New Series; Thence (6) southerly and westerly along Courses 32 and 33 of the last named Corporate Boundary to the true point of beginning, containing 5.28 acres more or less. PARCEL NO. 2: A 'parcel of land situate in the County of Kern, State of California and being a portion of Section 4, Township 30 South, Range 27 East, M.D.B. & M. Beginning at the southeasterly terminus of Course 13 of the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1778, New Series, said terminus being also a point on the southerly boundary of Tract No. 2548, distant 117.06 feet westerly as measured along the southerly boundary of Tract No. 2548 from the southeast corner thereof, said Tract being as shown on a map recorded August 17, 1961 in Book 12 of Maps at Pages 56, 57, and 58, Records of said Kern County; Thence (1) (Using the bearing of S 62°29'53"E of the south line of said Tract No. 2548 as a basis of bearing), departing from said Corporate Boundary, S 62°29'53"E, 117.06 feet, to the southeast corner of said Tract No. 2548; Thence (2) S 32°24'37'~, 187.80 feet; Thence (3) S 26°08'37'~Y, 152.95 feet; Thence (4). S 24'°02'37"W, 175785 ' 'e 'i Thence (5) S 5°49'07"W, 168.90 feet; Thence (6) S 78°18'10'~, 86.46 feet, to the northeast corner of that certain parcel of land designated as Parcel 2 in a deed -2- recorded June 12, 1928 in Book 246, at Page 382, Official Records of said Kern County, said northeast corner being also the southerly terminus of Course 15 of the Corporate Boundary of the City of Bakersfield as defined by said Ordinance No. 1778, New Series; Thence (7) northerly and northeasterly along Courses 15 and 14 of the last named Corporate Boundary to the point of beginning, containing 1.71 acres, more or less. 2. That unless any 'portion shall be excluded by the City Council, all portions of said unincorporated territory shall u'pon annexation to the City of Bakersfield be included within the Greater Bakersfield Separation of Grade District. 3.
