A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD SUPPORTING ASSEMBLY BILL 151

ASSEMBLYMAN KENT STACEY.
WHEREAS, the Bradley-Burns Local Sales and Use Tax Act
provides that the State Board of Equalization, 'pursuant to contract
with the City, will collect sales and use taxes for municipalities
only so long as a county has a sales and use tax ordinance in
effect; and .=
WHEREAS, a city's sales and use tax ordinance could be
rendered ineffective by the act of a separate governmental body,
namely, the Board of Supervisors rescinding or repealing the county
sales and use tax ordinance; and
WHEREAS, such an event could result in a heavy increase
in property taxes at a time when pro'perty taxes are already
burdensome; and
WHEREAS, this delegation of legislative authority to a
separate governmental entity deprives the cities of a basic concept
of levying taxes within their own jurisdiction; and
WHEREAS, AB 151 provides that city sales and use taxes
will be collected by the State Board of Equalization 'pursuant to
contract so long as the city has a sales and use tax ordinance in
effect; and
WHEREAS, AB 151 returns to the local jurisdictions their
rightful powers to carry out the functions of government for which
they were created and for which they are accountable to the
people within their jurisdiction; and
WHEREAS, a contract between a city and state agency could
not be nullified at the whim and caprice of the county if AB 151
becomes law.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. The City of Bakersfield endorses AB 151 and urges
its 'passage by the State Legislature.
2. The City of Bakersfield commends Assemblyman
William M. Ketchum, the author of AB 151, Senator Walter W. Stiern
and Assemblyman Kent H. Stacey, coauthors of AB 151 for introducing
this legislation.
3. The City Clerk is ordered to send copies of this
Resolution to the foregoing.

I HEREBY CERTIFY that the foregoing Resolution was
'passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 26th day of January, 1970, by
the following vote:
