HomeMy WebLinkAboutRES NO 03-70RESOLUTION NO." 3~70 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF JAMES STREET IN THE CITY OF BAKERSFIELD. WHEREAS, on the 15th day of December, 1969, the Council of the City of Bakersfield, 'pursuant to the provisions of the "Street Vacation Act of 1941", being Division 9, Part 3, of the Streets and Highways Code of the State of California, 'passed and adopted its Resolution of Intention No. 849, declaring its intention to order the vacation of a portion of James Street situate in the City of Bakersfield, California; and WHEREAS, said Council did fix a time and 'place for hearing all 'persons interested in or objecting to said 'pro'posed vacation, which said hearing was held on the 5th day of January, 1970, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that portion of James Street 'situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for 'present or prospective 'public street purposes: All that portion of James Street in the City of Bakersfield, as 'per the map of Homaker Park recorded A'pril 1, 1915 in Book 3 of Maps at Page 9, Kern County Records, described as follows: PARCEL 1 The northeasterly 40 feet of the 60 foot right-of-way ~or James Street as shown on said map, bounded on the west by the northerly 'prolongation of the easterly right-of-way line of "Q" Street of 82.5 feet in width, and bounded on the southeast by the northeasterly 'prolongation of course (3) of that parcel of land described in the Easement Deed re- corded August. 27, 1963 in Book 3638 of.Deeds at--Page 564.0and,565,-Kern County 'R~'cDrds, said course (3) and itS.northeasterly prolongation being a line parallel with and distant 20 feet northwesterly as measured at right angles to the northerly right-of-way line of State Highway VI-KER-178; retaining the northeasterly 10 feet and the southeasterly 15 feet of the above-described parcel of land for the purpose of a storm drain easement. PARCEL 2 That ~portion of the 8-foot Public Utilities Easement retained by Resolution No. 750, recorded June 20, 1960 in Book 3276 at Page 853, Kern County Records, bounded on the west by the northerly prolongation of the easterly right-of-way line of "Q" Street of 82.5 feet in width, and bounded on the southeast by the before-mentioned course (3); retaining the southeasterly 15 feet of the above-described parcel of land for the purpose of a storm drain easement. 2. That said portion of James Street be and the same is hereby closed up, vacated and abandoned for public street 'purposes subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 849. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 5th day of January, 1970, by the following vote: NOES: COUNCILMEN: ' ABSENT COUNCI~;,~EN: ' ....... .....
