HomeMy WebLinkAboutRES NO 01-70 RESOLUTION NO..' 1-70 RESOLUTION OFi THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF 38TH STREET AND A PORTION OF 36TH STREET, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 8th day of December, 1969, the Council of the City of Bakersfield, 'pursuant to the provisions of the "Street Vacation Act of 1941", being Division 9, Part 3, of the Streets and Highways Code of the State of California, 'passed and adopted its Resolution of Intention No. 847, declaring its intention to order the vacation of a portion of 38th Street and a portion of 36th Street, City of Bakersfield, California; and WHEREAS, said C!ouncil did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 5th day of January, 1970, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that 'portion of 38th Street and that portion of 36th Street situate in t~e City of Bakersfield, County of Kern, State of California, more particularly described as follows, Are unnecessary for 'present or prospective 'public street purposes: DESCRIPTION OF PORTION OF 38TH STREET TO BE ABANDONED All that portion of 38th Street in the City of Bakersfield, as shown on the map filed April 19, 1904, in Book 1 of Maps at page 13, Kern County Records, described as follows: The southerly 22.5 feet of the 82.5 foot right of way for 38th Street as shown on said map, lying between the northerly 'prolongations of the east boundary line and the west boundary line of Block 658 as shown on said map. All that r 36th Street in the City of Bakersfield, as shown on the map filed April 19, 1904, in Book 1 of Maps at Ipage 13, Kern County Records, described as follows: PARCEL 1 The northerly 11.25 feet and the southerly 11.25 feet of the 82.5 foot right of way for 36th Street as shown on said map, lying between the northerly prolongations of the east boundary line and the west boundary line of Block 630 as shown on said map. PARCEL 2 The northerly 11.25 feet and the southerly 11.25 feet of the 82.5 foot right of way for 36th Street as shown on said map, lying between the northerly prolongations of the east boundary line and the west boundary line of Block 631 as shown on said. map. 2. That said 'portion of 38th Street and said 'portion of 36th Street be and the same are hereby closed up, vacated and abandoned for 'public street 'purlposes subject to and in conformity with said Resolution of Intention No. 847. Reference to said Resolution of Intention is hereby made for further 'particulars. 3.
