HomeMy WebLinkAboutRES NO 42-74RESOLUTION NO. 42-74 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, MAKING DETERMINATIONS AND CONFIRMING ASSESSMENT OF THE COST OF DOING THE WORK ORDERED PURSUANT TO RESOLUTION OF INTENTION NO. 889. WHEREAS, the Superintendent of Streets of the City of Bakersfield, California, has heretofore, on the llth day of April, 1974, made and filed in the Office of the City Clerk of said City, an assessment and diagram for that: certain work and improvements in the City of Bakersfield, done under and pursuant to the Improve~ ment Act of 1911 (commencing at Section 5000 Streets and Highways Code), and Resolution of Intention No. 889; and WHEREAS, after the filing of said assessment and diagram, the Acting City Clerk has given Notice of the filing of said assess- ment and of the time and place set: for hearing thereon by the City Council, and said Acting City Clerk having executed a certificate setting forth the time and manner of mailing, posting and publish- ing of said notices; and WHEREAS, at the time and place stated in said Notice, a hearing was duly held by the City Council, and said assessment and diagram were presented and considered, and all written appeals, protests and objections, if any, were duly presented, read, heard and considered and all persons desiring to be heard thereon, were heard in respect to any matters relating to said work or improvement or to any act or determination of the Superintendent of Streets in relation thereto, or to the contract for said work or the performance thereof, or to the omissions or inclusions of any portions of said work in said contract, or to the correctness of said assessments or said diagram, or to any other act, determination or proceedings of said Superintendent of Streets, or to any matter relating to said work, thelassessment district or the proceedings therefor, and said City Council, having received evidence relating to the foregoing. NOW, THEREFORE, the City Council of the City of Bakersfield, does hereby Find, Resolve, Determine and Order as follows: SECTION 1. Said hearing has been duly held, and Notice thereof has 'been given according to law. SECTION 2. All protests and objections, written or oral, if any, made or filed with respect to said assessment, diagram and other matters heard by the City Council, be and the same are hereby overruled and denied. SECTION 3. Each and every step in the proceedings, prior to and including said hearing, has been duly and regularly taken, and this City Council is satisfied with the correctness of the assessment, the diagram, the proceedings and all matters relating thereto, and does hereby confirm said proceedings and said assessments and diagram. SECTION 4. That pursuant to Section 3114 of the Streets and Highways Code, the Acting City Clerk is hereby ordered and shall cause to be recorded in the ~ffice of the Kern County Recorder a copy of the assessment, diagram and notice of assessment for Public Improvement District No. 889. .... o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on Monday, the 7:3r~ day of:June,~974, by the following vote: AYES: COUNCILMEN .BL,.E. geE~, HEISEY, MEDDERS, ROGERS, ~ THOMA~ NOES: COUNCJLMEN: "'~.
