HomeMy WebLinkAboutRES NO 35-74RESOLUTION NO. -35-7j~ A RESOLUTION OF APPLICATION BY THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING THE DETACHMENT OF THOSE PORTIONS OF RECENTLY ANNEXED TERRITORY FROM THE NORTH BAKERSFIELD RECREATION AND PARK DISTRICT. SECTION 1: WHEREAS, a) By its Resolutions, the Kern County Local Agency Formation Commission approved the proposals for annexation to the City of Bakersfield, identified and more particularly set forth as follows: Resolution No. 68-35 adopted on November 26, 1968 (Proceeding No. 185) identified as Stockdale No. 1 in City of Bakersfield Ordinance No. 1778, New Series, adopted February 17, 1969, effective March 17, 1969. (A portion of such annexed' territory lies within the North Bakersfield Recreation and Park District.) ~ Resolution No. 71-14 adopted on March 23, 1971 (Proceeding No. 275) identified as Stockdale No. 4 in City of Bakersfield'Ordinance No. 1932, New Series, adopted May 17, 1971, effective June 17, 1971. (A portion of such annexed territory lies within'the North Bakersfield Recreation and Park District.) Resolution No. 72-34 adopted on September 26, 1972 (Proceeding No. 343) identified as Kern River No. 1 in City of.Bakersfield Ordinance No. 2055, New Series, adopted November 13, 1972, effective December 17, 1972. Resolution No. 72-35 adopted on September 26, 1972 (Proceeding No. 344) identified as Kern River No. 2 in City of Bakersfield Ordinance No. 2057, New Series, adopted November 20, 1972, effective December 20, 1972. Resolution No. 72-36 adopted on September 26, 1972, (Proceeding No. 345) identified as Kern River No. 3 in City of Bakersfield Ordinance No. 2058, New Series, adopted November 20, 1972, effective December 20, 1972. Resolution No. 87-73 adopted on October 15, 1973, (Proceeding No. 395) identified as Rosedale No. 1 in City of Bakersfield Ordinance No. 2155, New Series, adopted December 10, 1973, effective January 14, 1974; and b)- Said annexations were effected in the manner prescribed by law; and c) This Council now proposes to effect detachment from the North Bakersfield Recreation and Park District ("District") of the portions of the territories heretofore annexed to the City of Bakersfield lying within the District, described in annexation proceedings listed above as items 1 and 2 and also proposes to effect detachment from the District of the territories heretofore annexed to the City of Bakersfield, described in annexation pro- ceedings listed above as items 3, 4, 5 and 6, together with that portion of the territory excluded from item 4; all of such territories heretofore annexed to the City which lie within such District, together with that portion of the territory excluded from item 4, are described in Exhibit A, hereinafter referred to. SECTION 2: NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of the City of Bakersfield as follows: 1. Pursuant to Section 56195 of the Government Code of the State of California this Council hereby adopts its resolution of application, and in accordance with Section 56140 of said Code states as follows: (i) This resolution is made pursuant to Division 1 (commencing with Section 56000) of Title 6 of the Government Code. (ii) The nature of the proposed change of organization is: detachment from the North Bakersfield Recreation and Park District of territories which have been annexed to the City of Bakersfield, together with that portion of the territory excluded from Kern River No. 2 Annexation, item 4 above. (iii) The territory proposed to be detached is uninhabited; the boundaries of such territory are more particularly' described in Exhibit A appended hereto and made a part hereof by specific reference· (iv) There are no proposed terms and conditions to which the proposed change of organization is desired to be subject· (v) The reason for the proposal is: The territory contained within the aforementioned annexations to the City of Bakersfield which lie within the North Bakersfield Recreation and Park District will receive from said City, as a Municipal function thereof, all of the services and functions provided to said terri- tory by the North Bakersfield Recreation and Park District; the detachment of said territory from the said district will therefore relieve said territory from taxation by the North Bakersfield Recreation and Park District and as to the area excluded in the final approval of Kern River No. 2 ann~x~tio~:,would eliminate the creation of an island in the district which would be isolated from the remainder of the district. 2. In accord with all the foregoing request is hereby made: (i) That proceedings be taken for change of organi- zation proposed herein, to wit: detachment of the portions of territories of Stockdale No. 1 and Stockdale No. 4 which lie within the North Bakersfield Recreation and Park District and Kern River No. 1, Kern River No. 2, Kern River No. 3 and Rosedale No. 1, as described, from the North Bakersfield Recreation and Park District, together with said area excluded in the final approval of annexation Kern River No. 2, item 4 above. 3. The City of Bakersfield shall forthwith file with the Kern County Local Agency Formation Commission nine (9) certi- fied copies of this resolution, Form LAFCKC #7 (Rev. 5/70) and Form LAFCKC #27 (Rev. 4/74), pursuant to the regulations of the Commission.
