HomeMy WebLinkAboutRES NO 33-74~ESOIIFEION NO. -'-3~r74 A-RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING ·FINDING CONCERNING PROPOSED SUBDIVISION: TENTA~VE MAP OF TRACT NO. 8728' LOCATED IN SOUTHWEST BAKERSFI~'LD, SOUTH OF MING AVENUE AND WEST OF STINE ROAD ON. HASTI ACRES DRIVE. W11EREAS, Section 11526 (c) of the Business and Professions Code (Subdivision Map Act) states that a city shall not approve a tentative or final subdivision map unless the City Council of such ctty·.shall find that the proposed subdivision, together with the FroVisions for its design and improvements, is consistent with the general plan and applicable s~ecific plans of the city; and WHEREAS, the City Planning Commission, on May 1, , 19 74 did make the finding required by the above statute and recom- · · mended that the City Council make such finding; and WHEREAS, the City Planning Commission, on May 1 . , 49 74, approved the tentative map of Tract No. 8728 conditioned o~ the making of the appropriate finding by the City Council under sa~d Section 11526 (c); and WHEREAS, a copy of said tentative map, together with the Planning staff report and other related papers and documents have been filed with this City Council. . NOW, THEREFOE, BE IT RESOLVED by the Council of-the City of Bakersfield, as follows: 1. It is hereby found and determined that the proposed subdivision designated Tract No. 8728 , together with-the pro- --visions-for it's--design and improvement, i'S"consi~ten~ with the general plan and applicable specific plans of the City of Bakersfield. 2. Where the final soil report has not been com- pleted until after the recording of the final map, a separate certificate signed and issued by the city engineer must be recorded with the County Recorder of Kern County before a building permit may be issued, Provisions to be made for adequate fire protect[on to the satis~action of the fire chief of the City Fire Depai?tment· Turnaround easement in alley behind Lot 1, recorded in Book 4666 of Deeds, Page 86, automatically terminates upon recordat[on of the subdivision map.
