HomeMy WebLinkAboutRES NO 10-74RESOLUTION NO. 10-74 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROVIDING FOR CONSOLIDATION OF THE BAKERSFIELD SPECIAL MUNICIPAL ELECTION TO FILL A VACANCY IN THE SEVENTH WARD IN THE OFFICE OF COUNCILMAN, WITH THE STATE OF CALIFORNIA DIRECT PRIMARY ELECTION TO BE HELD ON JUNE 4, 1974, AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF KERN TO ORDER THE CONSOLIDATION OF SAID ELECTIONS. WHEREAS, Section 23302 of the Elections Code of the State of California provides that whenever an election called by a city for the submission of any office to be filled is to appear upon the same ballot as that provided for a statewide election, the city shall, at least 74 days prior to the date of the election, file with the Board of Supervisors, and a copy with the County Clerk, a resolution of its governing board requesting such consolidation and setting forth the exact form of any office to be voted upon at such election, as the same is to appear on the ballot; and WHEREAS, on the 4th day of February, 1974, pursuant to Section 16 of Article III of the Bakersfield City Charter, the City Council of the City of Bakersfield did pass and adopt Resolution No. 9-74 calling a Special Municipal Election to be held in the Seventh Ward of the City of Bakersfield on the 4th day of June, 1974, for the purpose of filling the vacancy in said Seventh Ward in the office of City Councilman for the remainder of the unexpired term; and WHEREAS, it is the desire of the City Council of the City of Bakersfield that said Special Municipal Election be consoli- dated with the State of California Direct Primary Election to be held June 4, 1974. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That the Board of Supervisors of the County of Kern is hereby requested to make an order, pursuant to Section 23302 of the ]Elections Code of the State of California, consolidating the Special Election called by the Council of the City of Bakersfield for June 4, 1974, with the State of California Direct Primary Election to be held on the same date. 2. That the exact form of the office to be voted upon at such election as the same is t'o appear on the ballot, is as follows: $OUNCILMAN - SEVENTH WARD Vote FOr 3'. That said Board of Supervisors is further requested to provide that within the Seventh Ward of the City of Bakersfield, the election precincts, polling places and voting booths shall, in every case, be the same and there shall be only one set of election officers in each of the precincts established in the Seventh Ward for said Special Municipal Election and the State of California Direct ]Primary Election and that the exact form of the office to be voted upon and the names of the candidates for such office as filed with the County Clerk, shall be set forth in each ballot to be used at said Special Municipal Election within the Seventh Ward. 4. Said Board of Supervisors of Kern County is further requested to cause said City office and such list of candidates to be printed upon each of the ballots to be used in the said Seventh Ward of the City of Bakersfield at said SpeCial Municipal Election consolidated with the State of California Direct Primary Election, within the Seventh Ward, including absent voter ballots. Said Board is further requested to cause to be set forth said City office and list of candidates therefor on all sample ballots relating to said Special Municipal Election and to mail to the qualified electors of the Seventh Ward said sample ballots and polling place cards relating to said Special Municipal Election, all in the time and_in the form required by law and to provide absent voter ballots for said consolidated election for use by qualified electors of the Seventh Ward in the City of Bakersfield who may be entitled thereto, in the manner provided by law. 5. That the Board of Supervisors of the County of Kern is hereby authorized to canvass or cause to be canvassed the returns of said Special Municipal Election in the Seventh Ward of the City of Bakersfield, and are requested to certify the results of the canvass of said returns to the Council of the City of Bakersfield, who shall thereupon declare the results thereof. 6. That the City Clerk or any employee in such office is hereby directed to transmit and file certified copies of this resolution with the Board of Supervisors of Kern County and the County Clerk of Kern County, as required by Section 23302 of the Elections Code of the State of California. Any employee of said City Clerk's Office may certify copies of this resolution. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of.
