HomeMy WebLinkAboutRES NO 9-74RESOLUTION NO. ~-74;' RESOLUTION AND ORDER OF THE COUNCIL OF THE CITY OF BAKERSFIELD CALLING A SPECIAL MUNICIPAL ELECTION IN THE SEVENTH WARD TO FILL A VACANCY IN THE COUNCIL OF THE CITY.AND PRESCRIBING THE FORM OF NOTICE OF ELECTION. WHEREAS, a vacancy now exists in the Council of the City of Bakersfield (in the Seventh Ward), at a time more than six months prior to the date of the next general election for said vacant council seat; and WHEREAS, a petition requesting that a special election be called to fill such vacancy has been filed with the Council within two weeks after the vacancy occurred; and WHEREAS, such petition contains the signatures of qualified electors of the Seventh Ward equal in number to at least twenty-five percent of the vote cast for Councilmanic candidates of that ward at the' last general election; and WHEREAS, the signatures to such petition have been verified and certified in the manner provided by law and such petition is valid; and WHEREAS, under Section 16 of the Charter of the City of Bakersfield it is now obligatory upon the Council to call a Special Election to fill the vacancy on the Council to be held not less than 90 days nor more than 180 days following certification of the petition and not less than 90 nor more than 120 days from the adoption of the resolution calling the election.~ NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED: 1. That a Special Municipal Election to fill the vacancy on the Council of the City of Bakersfi~ldifor the unexpi~ed term in the Seventh Ward is hereby called and shall be held on the ~th day of June, 1974. 2. That the polls shall be open in all precincts in the Seventh Ward from 7:00 a.m. to 8:00 p.m. 3. That the following form of Notice of Election shall be published once in the Daily Californian not later than the 68th day before the election but not earlier than the 89th day before the election: NOTICE OF SPECIAL MUNICIPAL ELECTION NOTICE IS HEREBY GIVEN that a Special Municipal Election will be held in the Seventh Ward of the City of Bakersfield on the 4th day of June, 1974, for the purpose of electing a councilman to fill the vacancy on the Council in said Seventh Ward, for the remainder of the unexpired term. That the polls shall be open in all precincts in the Seventh Ward from 7:00 a.m. to 8:00 p.m. Acting City Clerk of the City of Bakersfield 4. That the City Clerk shall give such further notices as are required by law and perform or cause to be performed all the duties and functions required by law.
