HomeMy WebLinkAboutRES NO 105-73RESOLUTION NO. 105-73 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF "0" STREET FROM 34TH TO 38TH STREET CONTIGUOUS TO BLOCKS 631, 657 IN THE CITY OF BAKERSFIELD. WHEREAS, on the 26th day of November, 1973, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 895, declaring its intention to order' the vacation of a portion of "0" Street from 34thto 38th Street contiguous to Blocks 631 and 657, City of Bakersfield, California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 17th day of December, 1973, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that portion of "0" Street from 34th to 38th Street contiguous to Blocks 631 and 657, situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: PARCEL 1 The east 11.25 feet of "0" Street, of 82.5 feet in width, bounded on the south by the westerly extension of the south line of Block 631, City of Bakersfield, as said street and block are shown on a map entitled, '~ap of Northern Division of the Town of Bakersfield," filed April 26, 1889, in the Kern County Recorder's Office, and bounded on the north by a line parallel with and 11.25 feet north of, as measured at right angles, to the westerly extension of the north line of last named block. PARCEL 2 Containing 0.16 acre, more or less. The east 11.25 feet of "0" Street, of 82.5 feet in width, bounded on the south by a line lying south 11.25 feet, as measured at right angles, and parallel to the westerly extension of the south line.of Block 657, City of Bakersfield, as said street and block are shown on a map entitled '~ap of Northern Division of the Town of Bakersfield,~ filed April 26, 1889, in the Kern County Recorder's Office, and bounded on the north by the westerly extension of the south line of Block 664, as said Block is shown on the last-named map. Containing 0.18 acre, more or less. 2. That said portion of "0" Street from 34th to 38th Street contiguous to Blocks 631 and 657 be and the same is hereby closed up, vacated and abandoned for public street purposes subject to and in conformity with said Resolution of Intention No. 895. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City to be recorded in the office of the County Recorder of the County of Kern, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 17th day of December, 1973, by the following vote: AYES: COUNCILMEN BLEECKER, HEISEY, MEDDERS, ROGER~, ~j'~O~G, NO':q: COUt, ICILMEN: ......
