RESOLUTION NO. 93-73 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS AND DETERMINATIONS THAT OWNERS OF MORE THAN 60% OF THE AREA WITHIN THE BOUNDARIES OF THE PROPOSED PUBLIC IMPROVEMENT DISTRICT NO. 894 HAVE SIGNED WRITTEN PETITIONS FOR SPECIFIED IMPROVEMENTS AND WAIVING ALL PRO- CEEDINGS REQUIRED BY THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931. WHEREAS, the City Council at its regular meeting of October 15, 1973, received and placed on file the City Engineer's Certification of Sufficiency, and the petitions from residents adjacent to Lots 13 through 34 and Lots 49 through 66 of Tract No. 1320, and Blocks T and U of Sunset Tract within the City of Bakersfield, requesting the City Council to form a Public Improve- ment District for the construction of curbs, gutters, sidewalk, driveway approaches and alley returns; and WHEREAS, the City Council desires in accordance with said request to initiate proceedings under the Improvement Act of 1911 (commencing with Section 5000, Streets and Highways Code) for the construction of said improvements. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that: 1. The foregoing recitals are true and correct and the City Council so finds and determines. 2. The City Council finds and determines that the public interest, convenience and necessity require the construction of the improvements. 3. The City Council finds and determines that. said petitions filed with the City Clerk of the City of Bakersfield, who is the Ex Officio Clerk of the Council of said City, the legislative body undertaking said proceedings, have been signed e . by the owners of more than sixty per cent (60%) in area of all of the property subject to assessment for the cost of the proposed improvement work hereinafter described and hereby grants said petition requesting said work and determines that the investigation and other requirements provided by the Special Assessment Investi- gation, Limitation and Majority Peotest Act of 1931 have been waived in connection with said improvement work by virtue of the provisions of subsections (2) and (3) of Section 2804 of the Streets and Highways Code. 4. Said improvement work and construction to be done in the City of Bakersfield described as follows: The construction of curbs, gutters, sidewalk, driveway approaches and alley returns adjacent to Lots 13 through 34 and Lots 49 through 66 of Tract No. 1320, and Blocks T and U of Sunset Tract, in the City of Bakersfield, California. 5. All of said work to be done within the Improvement District described in the boundary description marked Exhibit '~" and shown on the map attached and marked Exhibit "B." ----------000---------- 2 . e . Thence (1) westerly along said center line of California Avenue a distance 392.43 feet to a point on the ~ortherly prolongation of the west line of Lot 49 of said tract~; Thence (2) southerly along the said last named northerly prolongation of the west line to a point of the south line of Lot 49 of said tract. Thence (3) westerly along last named south line to a point on the center line of Brown Street. Thence (4) southerly along center line of Brown Street to the intersection with the centerline of Clarendon Street in accordance with Tract l320~ Thence (5) easterly along center line of Clarendon Street to the intersection with the center line of Collins Way in accordance with Tract 1320.
