A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AGREEING TO ACCEPT TITLE FROM
STATE OF PARCEL OF HIGHWAY RIGHT-OF-WAY ON
CALIFORNIA AVENUE WEST OF OAK AND AGREEING
TO ASSUME MAINTENANCE AND CONTROL UPON STATE
RELINQUISHMENT AND WAIVING FURTHER NOTICE.
WHEREAS, the State of California is the owner in fee of
a parcel of State highway right-of-way on California Avenue just
west of Oak Street, road 06-Ker-99; as said parcel is shoWIT, out-
lined in red, on the map entitled EXHIBIT "A" attached hereto and
made a part hereof; and
WHEREAS, State has revised the northerly right-of-way
along California Avenue, including the limits of access restriction,
in connection with the proposed development plans for the property
at the northwest corner; and
WHEREAS, State desires to limit ownership of its freeway
right-of-way along California Avenue only to the extent of the
access restrictions as established by the State; and
WHEREAS, said parcel falls outside said access restric-
tions and should properly belong under the jurisdiction of the
City of Bakersfield!
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Bakersfield as follows:
a. That the City of Bakersfield agrees to accept title
to said highway right-of-way and assume control and maintenance of
said highway right-of-way upon relinquishment by the State of
California.
b. That the City of Bakersfield does hereby waive the
90-days'notice requirement of the intention of the California
Highway Commission to relinquish such State highway right-of-way
as proviqed in Section 73 of the Streets and Highways Code of
the State of California.

That the City Clerk is directed to forward two
certified copies of this resolution to the State Department of
Transportation, District 06, P. O. Box 1352, Fresno, California
93715.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
