A RESOLUTION OF THE 'COUNCIL OF THE CITY OF BAKERSFIELD }~KING FINDING CONCERNING PROPOSED SUBDIVISION: TENTATIVE MAP OF TRACT NO. 3692 LOCATED THREE-FOURTHS MILE WEST OF NEW STINE ROAD, NORTH OF MING AVENUE, SOUTH OF KERN CITY GOLF COURSE~ '. WHEREAS, Section 11526 (c) of the Business and Professions Code (Subdivision Map Act) states that a.city shall not approve a tentative or final subdivision map unless the City Council of such city shall find that the proposed subdivision, together with the provisions for its design and improvements, is consistent with the' general plan and applicable specific plans of the city; and WHEREAS, the City Planning Commission, on October 3 , 19 73 " did make the finding required by the above sta.tute and recom- - mended that the City Council make such finding; and .WHEREAS, the City Planning Commission, on October 3 ~19~, approved the tentative map .of Tract No. 3692 conditioned on the making of the appropriate finding by the City Council under said Section 11526 (c); and WHEREAS, a copy of said tentative map, together with the c Planning sta~f report and other related papers and documents have been fi+ed with this City Council. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. It is hereby found and determined that the proposed subdivision designated Tract No. 3692 , together with the pro- visions for its design and improvement, is consis'tent with the general plan and applicable specific plans of the City of Bakersfield. . After review and deliberation, it was moved by Commissioner Joe Davis, seconded by Commissioner Albert C. Lum, and carried, that Tentative Tract 3692, together with provisions for its design and improvement, is consistent with applicable general and specific plans and recommended that said map be approved as submitted and on file subject to the following conditions as set forth: 1) Water supply to be provided to the satisfaction of the Fire Chief of the City Fire" Department, and fire hydrant locations as shown in RED. 2) Easements and street lighting to be provided to the satisfaction of the City Engineer. 3) Drainage to be proVided to the satisfaction of the City Engineer. 4) Soils report with minimum data in accordance with Ordinance 1613 N. S. (Res. 38-66). 5) No building permit on any lot within the tract shall be issued or be valid unti 1 the final soil report for this tract has been filed with the Building Director and the City Engineer and certified by the Engineer on the final recorded map. Where the final soi 1 report has not been completed unti 1 after the recording of the final map, a separate certificate signed and issued by the City Engineer must be recorded with the County Recorder .of Kern County before a building permit may be issued. 6) Provisions to be made for adequate fire protection to the satisfaction of the Fire Chief of the City Fire Department. 7) A six (6) foot masonry wall along Ming Avenue to the rear of Lots 38 - 44, 54 and 55, to match existing decorative masonry wall to the East.
