'.7~-7~ A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDING CONCERNING PROPOSED SUBDIVISION: TENTATIVE TRACT NO. 3683 (OPTIONAL DESIGN), LOCATED SOUTH OF WILSON ROAD AND EAST OF NEW STINE ROAD. WHEREAS,' Section 11526 (c) of the Business and Professions Code (Subdivision Map Act) states that a city shall not approve a tentative or final subdivision map unless the City Council of such city shall find that the proposed subdivision, together with the provisions for its design and improvements, is consistent with the general plan and applicable specific plans of the city;.and WHEREAS, the City Planning Commission, on September 5 , '19 73 , did make the finding required by the above statute and recom- mended that the City Council make such finding; and WHEREAS, the City. Planning Commission, on September 5 , '-19 73 approved the tentative map of Tract No. 3683 conditioned , , on the making of the appropriate finding by the City Council under said Section 11526 (c); and' WHEREAS, a copy of said tentative map, together with the Planning staff report and other related papers and documents have been filed with 'this City Council. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. It is hereby found and determined that the proposed subdivision designated Tract No. 3683 together with the pro- , visions for its design and improvement, is consistent with the general plan and. applicable specific plans of the City of Bakersfield. 2. That a copy of this Resc!~ion be forthwith transmitted to the Planning Department by the City Clerk. SECTION 2. AFter review and deliberation, it was moved by Commissioner JE.ll Haddad, seconded by Commissioner Frederickson, and carried,. that Tentativ~ Tract No. 3683 COpt[onal Design), together with provisions For its design and im- provement, is consistent with applicable general and specific plans and recommended that said map be approved as submitted and on file, subject to the Following conditions as set forth: , 1) This Tentative Tract Map is being filed under Chapter 16.22 (Optional Design and improvement Standards) of the Municipal Code of the City of Bakersfield. A Memorandum of Justification (16.22.020) has been feted along with the Map and has I~een accepted to qualify for the Optional Design Standards, 2) Water supply to be provided to the satisfaction of the Fire Chief of the City Fire Department, and fire hydrant'locations as shown En RED, 3) Easements and street lighting to be provided to the satisfaction of the City Engineer, 4) Drainage to be provided to the satisfaction of the City Engineer. 5) Soils Pepopt with minimum data in accordance with Q.rd[nance 1613 N. S., Res. 38-66, " 6) No building permit on any lot withEr the tract shall be issued or be valid until the final soil report For this tract has been filed with the Building Director and the City Engineer and cent[FLed by the Engineer on the Final recorded map. Where the final soil report has not been completed until aftten the recording of the Final map, a separate certificate signed and issued by the City Engineer must be recorded with the County Recorder of Kern County before a building permit may be issued. 8) Covenants, Conditions and Restrictions and Property Owner's Association papers are to be submitted and appnoved by Planning Department, City Attorney, and Public Works Department prior to FEnal[zation of the tentative -.' map. All of Lot 1 to be a common Public Uti'litEes Easement, and a utilities plan to be submitted and approved 'by the Building Department prior to finatEzatLon. 9) Twenty-foot alley easement north of tract boundary should either be included within the tract or a recorded document granting access to Lots 20 - 26, 10) East and west private streets ("A" & "C") should connect to allow access fop emergency equipment and refuse pickup, All private streets well be posted as private streets'and at no time will the City accept dedication or maintenance.
