HomeMy WebLinkAboutRES NO 53-73RESOLUTION N0. 53-73 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT CERTAIN TERRITORY DESIGNATED AS STOCKDALE NO. 6, AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexa- tion of certain unincorporated territory, designated as "STOCKDALE NO. 6," to the City of Bakersfield; and WHEREAS, all Of said territory lies outside the Greater Bakersfield Separation of Grade District; and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a part of the district to the same extent as such city; except such portion or portions thereof which the City Council has determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedings, is as follows: A parcel of land, situate in the County of Kern, State of California and being a portion of the west one-half of Section 15, Township 30 South, Range 27 East, M.D.B.& M. Beginning at the intersection of the east line of the west half of said Section 15 with the north right-of-way line of the Southern Pacific Railroad, Buttonwillow Branch, said intersection being northerly, along last said east line 91.49 feet, more or less from the south quarter corner of said Section 15, said intersection being a point in the Corporate Boundary of the City of Bakersfield;' Thence (1) departing from said Corporate Boundary, westerly along last said north right-of-way line, to intersect the west line of said Section 15, said last intersection being northerly 83.71 feet more or less, as measured along last said west line, from the south- west corner of said Section 15; Thence (2) northerly,.along the west line of said Section 15, to intersect the south line of the north 30 feet of said Section 15, said last named south line being the south right-of-way line of Fraser Road, 60 feet in width and also being a line in the Corporate Boundary of the City of Bakersfield; Thence (3) easterly and southerly, along the various courses of the said Corporate Boundary, to intersect the north right-of-way line of the Southern PacificIRailroad and the point of beginning. Containing 3i2.87 acres, more or less. 2. That unless any portion shall be excluded by the City Council, all portions of said unincorporated territory shall, upon annexation to the City of Bakersfield, be included within the Greater Bakersfield Separation of Grade District. 3.' That Monday, August 13, 1973, at the hour of 8 P. M., in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is the time when and the place where, objections to inclusion within the district, will be heard. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 9th day of July, 1973, by the following vote: Ayes: · Noes: Absent: Councilmen Thomas, Whittemore, Heisey,.Medders, Rogers, Strong None Cduncilman Bleecker ~, ..... ~ · .
