HomeMy WebLinkAboutRES NO 49-73RESOLUTION N0. ~49-73 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A SMALL PORTION OF THE W~ OF THE EXTENSION OF UNION AVENUE, LYING ADJACENT TO TRACT 3538, NORTH OF PANORAMA. WHEREAS, on the 21st day of May, 1973, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 891, declaring its intention to order the vacation of a small portion of the W~ of the extension of Union Avenue, lying adjacent to Tract 3538, North of Panorama, City of Bakersfield, California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 18th day of June, 1973, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that portion of the W~ of the extension of Union Avenue situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: All that portion of the east one-half of the southeast quarter of Section 18, Township 29 South, Range 28 East, M.D.B.& M., more particu- ~ larly described as follows: Beginning at a point in the east line of said Section 18, from which the southeast corner of said Section 18 bears S 00°49'54"E, 1650.67 feet thereon: Thence (1) S 45°40'51'~, 79.60 feet; Thence (2) N 00°49'54'~, parallel to the east line of said Section 18, 50.00 feet; Thence (3) N 45°40'51~'E,79.60 feet, to intersect the east line of said Section 18; Thence (4) S 00°49'54"E, along the east line of said Section 18, 50.00 feet to the point of beginning. 2. That said portion of the W~ of the extension of Union Avenue, lying adjacent to Tract 3538, North of Panorama be and the same is hereby closed up, vacated and abandoned for public street purposes subject. to and in conformity with said Resolution of Intention No. 891. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City to be recorded in the office of the County Recorder of the County of Kern, California. o0o I HEREBY CERTIFY that the.foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 18th day of June, 1973, by the following vote: AYES: NOES: ABSENT: ABSTAIN: Councilman Strong, Whittemore, Bleecker, Heisey, Medders, Rogers.
