HomeMy WebLinkAboutRES NO 35-73RESOLUTION NO. 35-73 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT A PORTION OF CERTAIN TERRITORY DESIGNATED AS "PACHECO NO. 5 ," AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexation of certain unincorporated territory, designated as "Pacheco No. 5," to the City of Bakersfield, and WHEREAS, all of said territory lies outside the Greater Bakersfield Separation of Grade District, and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise~included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a part of the district to the same extent as such city; except such portion or portions thereof which the City Council has determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedings, is as follows: A parcel of land situate in the County of Kern, State of California, and being a portion of the Section 18, Township 30 South, Range 28 East, M.D.B.& M., more particularly described as follows: Beginning at the intersection of the east line of the W 1/2 of the NW 1/4 of the SE 1/4 of said Section 18 with the south line of the north 55 feet of the SE 1/4 of said Section 18 said intersection being the northwest corner of Lot 1, Tract No. 2270, as said lot is shown on a map recorded in Book 10 of Maps, at page 168, records of said County, and being also a point on the Corporate Boundary of the City of Bakersfield; Thence (1) departin~ from said Corporate Boundary and as per said Tract No. 2270, S 0 01'09" E along the last-named east line, 410.00 feet, to a point on the north line of Tract No. 2397 as said Tract No. 2397 is shown on a map recorded in Book 11 of Maps, at page 185, Records of said County; Thence (2) as per said Tract No. 2397, S 89°58'51'~, 42.00 feet; Thence (3) S 0°01'09"E, 746.75 feet; Thence (4) N 89°58'51"E, 24.00 feet; Thence (5) S 0°01'09"E, 109.94 feet, to the southwest corner of Lot 14, said Tract No. 2397, said corner also being a point on the Corporate Boundary of the City of Bakersfield. Thence (6) westerly and along the various courses of said Corporate Boundary to the point of beginning, containing 18.69 acres; more or less. 2. That unless any portion shall be excluded by the City Council, all portions of said unincorporated territory shall, upon annexation to the City of Bakersfield, be included within the Greater Bakersfield Separation of Grade District. 3. That Monday, the 23rd day of July, 1973, at the hour of 8 P.
