HomeMy WebLinkAboutRES NO 33-73RESOLUTION NO. 33-73 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, STATE OF CALIFORNIA, EXTENDING TIME BY ONE YEAR WITHIN WHICH AFFECTED PROPERTY OWNERS MUST BE READY TO RECEIVE UNDERGROUND SERVICE AND WITHIN WHICH AFFECTED UTILITIES MUST UNDERGROUND FACILITIES IN DIVISIONS 2 AND 3 OF UNDERGROUND UTILITY DISTRICT NO. 2 AND REVISING DESCRIPTION OF SAID DIVISION 2. WHEREAS, Resolution No. 37-71, establishing Underground Utility District No. 2, fixed December 31, 1973 for Division 2 (County Building Area) and December 31, 1973 for Division 3 (City Hall area) as the dates on which affected property owners must be ready to receive underground service and ordered the removal of poles, etc. on or before such dates; and WHEREAS, Resolution No. 39-71 extended the time by 30 days within which the removal of all overhead structures and the underground installation of facilities for supplying the various utility service within District No. 2, to wit: until January 31, 1974; and WHEREAS, for good cause shown and as a matter of public interest, the City Council now desires to extend the deadlines above stated for a period of one year and to revise the description of Division 2 of District No. 2 so that the easterly boundary of Division 2 will fall on the centerline of "P" Street instead of on the easterly line of "P" Street. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That the times set forth in Resolutions No. 37-71 and 39-71 as they apply to Divisions 2 and 3 of Underground Utility District No. 2 are revised to read as follows: That the Council does hereby fix December 31, 1974, for Division 2 (County Building Area) and December 31, 1974, for Division 3 (City Hall Area) as the dates on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated over- head structures and the underground installation of wires and facilities for supplying electric, communication, cable television or similar or associated service within Divisions 2 and 3 of Under- ground Utility District No. 2 no later than January 31, 1975. 2. That the description set forth in Resolutions No. 27-71 and 37-71 of Division 2 (County Building Area) of Underground Utility District No. 2 is hereby revised and amended so that the easterly boundary of the Division will fall on the centerline of "P" Street instead of on the easterly line of "P" Street and shall read as follows: Division 2. County Buildin~ Area That area in the City of Bakersfield, State of California, more particularly described as follows: Beginning at the intersection of the easterly line of Chester Avenue and the southerly line of Truxtun Avenue; Thence easterly along said southerly line of Truxtun Avenue to the center line of "P" Street; Thence southerly along said center line of "P" Street to the northerly line of 15th Street; Thence westerly along said northerly line of 15th Street to the easterly line of Chester Avenue; Thence northerly along said easterly line of Chester Avenue to the southerly line of Truxtun Avenue, being the point of beginning. 3. -That the City Clerk is hereby instructed to-notify all affected utilities and all persons owning real property within Divisions 2 and 3 of Underground Utility District No. 2 of the adoption of this amendatory Resolution within ten (10) days after the date of such adoption. Said City Clerk shall by such Resolu- tion notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, cable television or other similar or associated service, they or such occupant shall, by the dates fixed in this Resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supply- ing utility or utilities ata new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. ..... o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 21st day of May, 1973, by the following vote: AYES: COUNCILMEN'~f=iC=K-.~, f~E~E~, MEDDERS, ROGERS, STRONG, THOMAS, WHITTEMORE) ~/~.~.
