HomeMy WebLinkAboutRES NO 89-72 . . , .. ~ RESOLUTION NO. 89-72_ RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT CERTAIN TERRITORY DESIGNATED AS STOCKDALE NO.5, AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexation of certain unincorporated territory, designated as "STOCKDALE NO.5," to the City of Bakersfield; and WHEREAS, all of said territory lies outside the Greater Bakersfield Separation of Grade District; and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a part of the district to the same extent as such city; except such portion or portions thereof which the City Council has determined, will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedings, is as follows: A parcel of land situate in the County of Kern, State of California, and being a portion of Section 10 and 15, Township 30 Souih, Range 27 East, M.D.B.& M. Beginning at the south quarter corner of Section 10, T.30 S., R.27 E, M.D.B.& M., being on the current Corporate Boundary of the City of Bakersfield described in Course 52, Ordinance No. 1799 N.S. e . ~ ~ Thence (1) south 30 feet, more or less, along the east line of the NW 1/4 of said Section 15 to intersect the south line of the north 30 feet of said Section 15; Thence (2) departing from said Corporate Boundary, westerly along the last-named south line to intersect the west line of said Section 15; Thence (3) north along west line of said Section 15 and along the west line of said Section 10 to the west quarter corner of said Section 10, said corner also being on the current Corporate Boundary of the City of Bakersfield as described in Course 51, Ordinance No. 1799 N.S.; Thence (4) easterly and southerly along the current Corporate Boundary of the City of Bakersfield as defined in Courses 51 and 52, Ordinance No. 1799 N.S. to the point of beginning, containing 161.20 acres, more or less. 2. That unless any portion shall be excluded by the City Council, all portions of said unincorporated territory shall, upon annexation to the City of Bakersfield, be included within the Greater Bakersfield Separation of Grade District. 3. That Monday, the 22nd day of :Jan~, 1973, at the hour of 8 P.
