HomeMy WebLinkAboutRES NO 87-72 - . ~ RESOLUTION NO. 87-72 . , RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF WESTBROOK DRIVE IN THE CITY OF BAKERSFIELD. WHEREAS, on the 13th day of November, 1972, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 882, declaring its intention to order the vacation of a portion of Westbrook Drive in the City of Bakers- field, California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 4th day of December, 1972, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That that portion of Westbrook Drive situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: A parcel of land situate in the City of Bakersfield, County of Kern, State of California, being a portion of the Northeast 1/4 of Section 11, Township 30 South, Range 27 East, M.D.B.& M. and more particularly described as follows: All that portion of Westbrook Drive, between Lot Nos. 23 and 27 of Tract No. 2720 as said Tract is shown on a map filed in the Office of the County Recorder of Kern County in Book 12 of Maps, Page 197 on June 15, 1962, and lying northerly of the following described line. Beginning at the intersection of the south property line of Lot No. 23 and the east right-of-way line of said Westbrook Drive, thence westerly in a straight line and ending at the inter- section of the northerly line of Lot No. 24 of said Tract with the west right-of-way line of said Westbrook Drive. e . Excepting and reserving a drain line easement 10 feet wide, 5 feet each side of the center line of Westbrook Drive, extending from the south line of above-described abandonment to the north right-of-way line of Westbrook Drive. 2. That said portion of Westbrook Drive be and the same is hereby closed up, vacated and abandoned for public street purposes subject to and in conformity with said Resolution of Intention No. 882. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City to be recorded in the office of the County Recorder of the County of Kern, California. ----------000---------- 2. -- . .;:.
