RESOLUTION NO. 85-72
A RESOLUTION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD DETERMINING
WHETHER ROUTE 58 FREEWAY WILL SEVER
NONMOTORIZED ROUTES.
WHEREAS, State Route 58 between Route 99 and Cotton-
wood Road is planned to be constructed as a freeway; and
WHEREAS, Section 100.11 of the Streets and Highways
Code prohibits the State from constructing a state highway as a
freeway that will result in the severance or destruction of
existing major nonmotorized routes (for pedestrians, equestrians,
bicycles, and light motorcycles), unless it provides all such
traffic a reasonable alternate route or such a route exists; and
WHEREAS, the Division of Highways by letter to the City
Council dated November 2, 1972, recommended that the Council deter-
mine whether the Route 58 Freeway will sever any county nonmotorized
routes or that a reasonable alternate route does exist for any
route so severed and that such route is consistent with the General
Plan for such facilities; and
WHEREAS, the recommendation has been reviewed by the City
Public Works Department and Police Department and the Bakersfield
City School District.
NOW, THEREFORE, the Council of the City of Bakersfield
hereby DETERMINES and RESOLVES as follows:
1. That the Route 58 Freeway as planned does not sever
or destroy any existing equestrian, btcycle or light motorcycle routes.
2. That pedestrian crossings at existing streets will
be severed by Route 58 Freeway between Route 99 and Cottonwood Road.
3. That the crossings planned to be provided by the
Division of Highways at the several locations for traffic crossing
of the Freeway will also include facilities for pedestrians to

cross which should provide reasonable alternate pedestrian routes
to the city streets which will be severed, consistent with the
General Plan.
4. That the Clerk transmit a certified copy of this
Resolution to the Division of Highways, care of T. S. Ashley,
Assistant District Engineer, Planning, P. O. Box 1352, Fresno,
California.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 4th day of December, 1972, by the following
vote:
