HomeMy WebLinkAboutRES NO 64-72RESOLUTION NO. 64,--72- RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT A PORTION OF CERTAIN TERRITORY DESIGNATED AS "KERN RIVER NO. 1," AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexation of certain unincorporated territory, designated as "Kern River No. 1," to the City of Bakersfield, and WHEREAS, a portion of said territory lies outside the Greater Bakersfield Separation of Grade District, and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a part of the district to the same extent as such city; except such portion or portions thereof which the City Council has determined, will not be benefited by inclusion in the.district. NOW, THEREFORE, be it resolved-by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedingS, is as follows: A parcel of land situate in the County of Kern, State of California and being a portion of Section 26, T. 29 S., R. 27 E., M.D.B.& M. and more particularly described as follows: Beginning at a point on the west line of'the NE 1/4 of said Section 26 lying 48.88 feet south, as measured along said west line, from the north one-quarter corner of said Section 26, said point being on the south right-of-way line of Rosedale Highway, of 110 feet in width, and being also a point on the Corporate Boundary of the City of Bakersfield; Thence (1) generally southerly and westerly along Said Corporate Boundary to the southwest corner of said Section 26; Thence (2) departing from said Corporate Boundary, northerly along the west line of said Section 26, 1445 feet, more or less, to a point in the northerly right-of-way line of the Atchison, Topeka and Santa Fe Railroad, of 100 feet in width; Thence (3) southeasterly along the last named northerly right-of-way 1 219.75 feet more or less, to intersect the south line of the NW /4 of the SW 1/4 of said Section 26; Thence (4) easterly along the last named south line, 1142.74 feet, more or less, to intersect the east line of the NW 1/4 of the SW 1/4 of said Section 26; Thence (5) northerly along the last named east line to intersect the north line of the SW 1/4 of said Section 26; Thence (6) easterly along the north line of the SW 1/4 of said Section 26, to intersect the east line of the W 1/2 of the W 1/2 of the SE 1/4 of the NW 1/4 of said Section 26; Thence (7) northerly along the last named'east line, 996.30'feet to intersect the south right-of-way line of Burr Road, of 60 feet in width; Thence (8) easterly along a line parallel with the south line of the NW 1/4 of said Section 26,.being also along said last named right-of-way line to intersect the west line of the E 1/2 of the E 1/2 of the NW 1/4 of said Section 26; .Thence (9) northerly, 718.6 feet, more or less, to intersect the south line of the north 963.40 feet of the NW 1/4 of said Section 26; Thence (10) easterly along the last named south line, 194.84 feet, more or less, to intersect the west line of the east 466.7 feet of the NW 1/4 of said Section 26; Thence (11) northerly along the last named west line, 924.06 feet, more or less to a point which lies 39~34 feet south of the north line of said Section 26, as measured along said west line, said point also being on the south right-of-way line of.Rosedale Highway, of 110 feet in width; Thence (12) easterly along the last named south right-of-way 466.78 feet, more or less, to the point ofbeginning, containing 223.68 acres, more or less. 2. That unless any portion shall be excluded by the City Council, all portions of said unincorporated territory shall upon ann~Xation~to the City of Bakersfield b~ included within the Greater Bakersfield Separation of Grade District. 3. That Monday, the 13th day of November, 1972, at the hour of 8 P.
