TER AVENUE. I WHEREAS) Section 11526 (c) of the Business and Professions Code (Subdivision Map Act) states that a city shall not approve a tentative or final subdivision map unless the City Council of such city shall find that the proposed subdivision) together with the provisions for its design and improvements) is consistent with the general plan and applicable specific plans of the city; and WHEREAS) the City Planning Commission, on AU9ust 16 19~) did make the finding required by the above statute and recom- mended that the City Council make such finding; and WHEREAS) the City Planning Conmlission, on August 16, -) 1972 , approved the tentative map of Tract No. 3597 conditioned on the making of the appropriate finding by the City Council under said Section 11526 (c); and , WHEREAS) a copy of said tentative map) together with the Planning staff report and other related papers and documents have been filed with this City Council. NOW) THEREFORE) BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. After review and delibera~ion, it was moved by Commissioner Vetter, seconded by Commissioner Lum, and carried, that Tentative Map of Tract No. 3597, together with provisiol")s.for its design and improvement, is consistent with applicable general and specific plans and recommended that said map be approved as submitted and on file sub- ject to. the following conditfons as set forth: " .:="""l 1 . 2. 3. 4. 5~ 6. 7. -- 8. 9. 10. -= 11. This T€ntative Tract Map is filed undf~r Chapter 16.22 (Optional DEsign & Improvement Standards) of the Municipal Code of the City of Bak~rs- field. A Memorandum of Justification (16.22.020) has been filed along with the Map and has been accepted to qualify for the Optional Design Standards. Water supply be provided to the satisfaction of the Chief Engineer of the City Fire Department, and f~re-hydrant locations as shown in red. Easements and street lighting be provided to the satisfaction of the City Engineer.' . Drainage be provided to the satisfaction of the City Engineer. Soils report with minimum data in accordance with Chapter 70 of the Uniform Building Code, 1970 Edition. Grading plan showing building pad elevation with respect to curb and gutter elevations. No building permit on any lot within the tract shall be issued or be valid until the final soil report for this tract has been filed with the Chief Build- ing Inspector and the City Engineer and certified by the Engineer on the final recorded map. Where the final soil report has not been completed until after the recording of the final map, a separate certificate signed and issued by the City Engineer must be recorded with the County Re- corder of Kern County before a building permit may be issued. Provisions be made for adequate fi re protection to the satisfaction of the Chief Engineer of the City Fire Department. Adequate provisions to be made for continuous maintenance of all private streets and common areas through an association and spelled out in full w'ithin the Deed Restrictions. The Deed Restrictions shall be approved by the Planning Staff, City Attorney, Public Works and Building Depart- ments prior to the final approval of the map by the City Council and re- corded along with the final map. A complete utility and drainage plan showing existing and required ease- ments and utility lines to be submitted and approved by Planning, Build- ing and Public Works Departments before submittal of the final map. All common areas (Lots 94 and 95) to be declared a public utility easement and shown on the map. Twenty (20) foot drive around perimeter of tract to be enlarged to a mini- mum of twenty-four (24) feet. Private drainage sump to be developed to city standards as to fencing and landscaping. . 12. A six-foot masonry wall along the west side of the tract as shown in red. Fence to be four-feet in height the first twenty-five (25) feet from Mer- rimac Avenue. 13. Lots 94 and 95 (common area) to be for recreational use only and not for additional dwelling units. Uses permitted, i~e. recreational buildings, laundry rooms, cabanas, swimming pools, temporary sales offices, re- fuse pickup points, etc. 14. The areas of private drives on Lots 94 and 95 shall be considered as pri.- vate drives and not at any time will the City of Bakersfield accept main- tenance or dedication of private drives.
