HomeMy WebLinkAboutRES NO 49-72RESOLUTION N0. 49-72 RESOLUTION OF INTENTION TO INCLUDE WITHIN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT CERTAIN TERRITORY DESIGNATED AS UNION AVENUE NO. 5, AND SETTING THE TIME AND PLACE FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID TERRITORY WITHIN SAID DISTRICT. WHEREAS, proceedings have been commenced for the annexa- tion of certain unincorporated territory, designated as "UNION AVENUE NO. 5," to the City of Bakersfield; and WHEREAS, all of said territory lies outside the Greater Bakersfield Separation of Grade District; and WHEREAS, Section 8290 of the Streets and Highways Code of the State of California, provides that the unincorporated territory of a county which was not included within a separation of grade district at the time of the formation of such district, and which subsequent to the formation of such district is annexed to or otherwise included within a city which is a part of such district, shall immediately upon such annexation to such city be included within the district and shall thereafter become a part of the district to the same extent as such city; except'-such portion or portions thereof which the City Council has determined,~ will not be benefited by inclusion in the district. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, as follows: 1. That a description of the unincorporated territory described in the annexation proceedings, is a follows: A parcel of land situate in the County of Kern, State of California, being a portion of the NE 1/4 of the NE 1/4 of Section 19, T. 30 S., R. 28 E., M.D.B.& M., and being also a portion of "Kern County Sales Map No. 1 of Lands of J. B. Haggin," filed for record May 3, 1889 in the Office of the County Recorder of said Kern County and more particularly described as follows: Beginnin~ at the intersection of the south line of the NE 1/4 of the NE 14 of said Section 19 with the west line of the east 57.75 feet of said Section 19, said intersection being the southeast corner of Lot 2 of said Section 19 of said Sales Map and also being a point on the west right-of-way line of Union AvenUe, of 115.5 feet in width; Thence (1) westerly along the last named south line, 302.25 feet, more or less, to intersect the west line of the east 360 feet of said Section 19, said intersection being a point, on the Corporate Boundary of the City of Bakersfield; Thence (2) northerly and easterly along said Corporate Boundary to intersect the west line of the east 57.75 feet of said Section 19, said intersection being the west right-of-way line of said Union Avenue. Thence (3) departing from said Corporate Boundary, southerly along the last named west line, 462 feet, more or less, to the point of beginning. Containing 3.21 acres of land, more or less. 2. That unless any portion shall be excluded by the City Council, all portions of said unincorporated territory shall, upon annexation to the City of Bakersfield, be included within the Greater Bakersfield Separation of Grade District. 3. That Monday, the 25th day of September, 1972, at the hour of 8 P.
