HomeMy WebLinkAboutRES NO 09-72RESOLUTION NO. '9-72 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A FRONTAGE ROAD ALONG MT. VERNON AVENUE, CITY OF BAKERSFIELD. WHEREAS, on the 14th day of February, 1972, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 872, declaring its intention to order the vacation of frontage road along Mt. Vernon Avenue, situate in the City of Bakersfield, County of Kern, State of California, and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 6th day of March, 1972, after notices were duly posted as required by law, and WHE~REAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That the frontage road along Mt. Vernon Avenue, situate in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: A parcel of land situate in the City of Bakersfield, County of Kern, State of California and being a portion of Section 21, T. 29 S., R. 28 E., M.D.M., said portion more particularly described as follows: Beginning at the northeast corner of Orange Villa Tract, as said Tract is shown on a map filed in the Office of the Kern County Recorder of the County of Kern, February 15, 1912. Thence (1) S 0Q17'39'~, 815.81 feet along the east line of said Orange Villa Tract to a point on the east line of said Section 21; Thence (2) N 89°26'57'~, 55.00 feet to the true point of beginning; Thence (3) continuing N 89°26'57'~W, 54.00 feet; Thence (4) S 0°17'39'~, 426.66 feet, more or less to intersect the north line of Tract 1629, as said Tract 1629 is shown on a map filed July 16, 1952, in Book 8 of Maps, Page 23, in the Office of the County Recorder of the County of Kern; Thence (5) east along the north line of said Tract 1629 to a point on the west line of the east 55.00 feet of said Section 21; Thence (6) N 0°17'39"E, along last-named west line 426.66 feet more or less to the true point of beginning. Excepting and reserving said parcel of land for a public utilities easement and hereby reserving all rights of ingress and egress on, over or under said parcel of land to the adjacent and abutting property owners. 2. That said frontage road along Mt. Vernon Avenue, be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and. in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 872. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California.
