A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD REQUESTING EXEMPTION FROM REQUIRE-
MENT OF COLLECTION OF FEE TO PROVIDE INSTRU-
MENTATION FOR INFORMATION USEFUL IN IMPROVING
DESIGN OF EARTHQUAKE RESISTANT STRUCTURES.
WHEREAS:
(1) Effective March 4, 1972, Chapter 8 (commencing with
Section 2700) of Division 2 of the Public Resources Code creates a
"Strong-Motion Instrumentation Program" to provide adequate instru-
mentation throughout California for the purpose of deriving informa-
tion to be used for improving the design and construction of earthquake-
resistant structures; and
(2) Under such program it is required that the City shall
collect a fee from all applicants for construction permits equal to
.007 per cent (7 cents per $1~000) of the estimated construction cost
of the structure, which fee is deposited in a special state fund and
appropriated to the Division of Mines and Geology.
(3) A city may be exempted from the requirement to collect
such fee i.f such city has adopted an ordinance requiring the installa-
tion of accelerographs in structures and at least one structure has
been instrumented with three accelerographs installed in accordance
with such ordinance prior to October 1, 1971, and the State Geologist
has received (on or before June 30,.1972), a written request of the
City Council that the city be exempted.
(4) This City Council desires to be exempted from the
provisions of Section 2705 of the Public Resources Code requiring
the collection of the .007 per cent fee and to this end makes the
following findings:
(a) The City of Bakersfield has adopted an ordinance
requiring the installation of accelerographs in structures within
the City.
(b) The structure known as Christian Towers, 3015
Wilson Road, Bakersfield, California, has been instrumented with a
minimum of three accelerographs installed in accordance with City
of Bakersfield ordinance requirements prior to October 1, 1971.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the City Council of the City of Bakersfield,
hereby requests exemption from the provisions of Section 2705 of the
Public Resources Code of the State of California, which section
requires that the City collect a fee from all applicsnts for con-
struction permits equal to .007 per cent of the estimated construc-
tion cost of the structure.
2. That the Clerk forthwith transmit a certified copy of
this resolution to the State Geologist, c/o Wesley G. Bruer, 1416
Ninth Street, Sacramento, California, 95814.

I HEREBY CERTIFY that the foregoing Resolution was passed
