HomeMy WebLinkAboutRES NO 04-72RESOLUTION NO. 4-79- A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CERTIFYING TITLE TO THE INTER- SECTIONS WITHIN THE "BAKERSFIELD TOPICS PLAN-2 FOR THE INSTALLATION AND MODIFICATION OF TRAFFIC SIGNALS AND STREET LIGHTING SYSTEMS AT VARIOUS INTERSECTIONS." SECTION 1. WHEREAS: (a) The State of California Division of Highways requires a certificate from the City concerning the title to City roadways which are to receive Federal Funds under the Urban Traffic Operations Program to Increase Capacity and Safety; and (b) It is desired by the Council of the City of Bakersfield that the following intersections be improved as an 06-T.O.P.I.C.S. Project: (1) Ming Avenue at Freeway '99 off-ramp, (2) Ming Avenue at South Real Road, (3) Oak Street at Palm Street, and (4) Oak Street at Chester Lane (including only those portions within the corporate limits). NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, State of California, that the City of Bakersfield does hereby certify that it has good title as City to said rights-of-way aforedescribed, and the Mayor is directed to show the City's act by signing and delivering to said Division of Highways the attached certificate. o0o- I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 7th day of February, 1972, by the following vote: AYES, COUNCILMEN BLEECKER, HEISEY, MEDDERS, REES, RUCKER, ~ WHITEMORE NoEs, CO~NC,LME..,.:.._~. ~ ouNc,LMEN,. .... ABSTAINING COUNCILMEN: C K and' ficio Clerk of the E Council of the City of Bakersfield APPROVED: da,~f_..February, 1972 ~f Bakersfield RIGHTS-OF-WAY CERTIFICATE The City of Bakersfield, by and through its Mayor, duly authorized to execute this Certificate, 'hereby certifies, in connection with the rights-of-way for the following 06-T.O.P.I.C.S. Project intersections: (1) FLing Avenue at Freeway 99 Off-Ramp, (2) Ming Avenue at South Real Road, (3) Oak Street at Palm Street, and (4) Oak Street at Chester Lane (including only those portions within the corporate limits). That all required rights-of-way for construction of these projects have been acquired by the City of Bakersfield by appropriate legal instrument (grant deeds, subdivision dedication); and the following is hereby certified: 1. Status of Right-of-Way Acquisitions. The entire rights-of-way for these projects were acquired by street right-of-way deed or subdivision dedication. 2. Status of Affected Railroad Facilities. There are no railroad facilities within the limits of these projects. 3. Designated Material Sites. There are no material sites designated for these proj e c t s. projects. projects. Compliance with Relocation Advisory Assistance and Payments Provisions of Federal and State Law. Compliance with t'he provisions of IM-80-1-68 was not required for these projects. The City of Bakersfield agrees to 'hold the State of California harmless from any liability which may result in the event the rights-of-way are not clear as certified. If the State is named in a damage suit, as a result of the rights-of-way not being clear as certified, the City of Bakersfield agrees that, at t'he request of the State, it will assume full responsibility for the conduct of the defense or provide such assistance as the State may require and will pay any judgments issued against the State and all costs in connection with the defense.
